|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE SENATE SENATE BILL NO. 1040 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO SPECIAL MOTOR VEHICLE LICENSE PLATES; AMENDING SECTION 49-402, 3 IDAHO CODE, TO PROVIDE A CODE REFERENCE AND TO PROVIDE CORRECT CODE REFER- 4 ENCES; AMENDING CHAPTER 4, TITLE 49, BY THE ADDITION OF A NEW SECTION 5 49-419C, IDAHO CODE, TO ESTABLISH AN IDAHO WHITE WATER SPECIAL LICENSE 6 PLATE PROGRAM; AND PROVIDING AN EFFECTIVE DATE. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 49-402, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 49-402. ANNUAL REGISTRATION. (1) The annual fee for operating each pickup 11 truck and each other motor vehicle having a maximum gross weight not in excess 12 of eight thousand (8,000) pounds shall be: 13 Vehicles one (1) and two (2) years old ............................ $48.00 14 Vehicles three (3) and four (4) years old ......................... $36.00 15 Vehicles five (5) and six (6) years old ........................... $36.00 16 Vehicles seven (7) and eight (8) years old ........................ $24.00 17 Vehicles over eight (8) years old ................................. $24.00 18 There shall be twelve (12) registration periods, starting in January for 19 holders of validation registration stickers numbered 1, and proceeding consec- 20 utively through December for holders of validation registration stickers num- 21 bered 12, each of which shall start on the first day of a calendar month and 22 end on the last day of the twelfth month from the first day of the beginning 23 month. Registration periods shall expire midnight on the last day of the reg- 24 istration period in the year designated by the validation registration 25 sticker. The numeral digit on the validation registration stickers shall, as 26 does the registration card, fix the registration period under the staggered 27 plate system of Idaho for the purpose of reregistration and notice of expira- 28 tion. 29 A vehicle that has once been registered for any of the above designated 30 periods shall, upon reregistration, be registered for the period bearing the 31 same number, and the registration card shall show and be the exclusive proof 32 of the expiration date of registration and licensing. Vehicles may be ini- 33 tially registered for less than a twelve (12) month period, or for more than a 34 twelve (12) month period, and the fee prorated on a monthly basis if the frac- 35 tional registration tends to fulfill the purpose of the monthly series regis- 36 tration system. 37 (2) For all school buses operated either by a nonprofit, nonpublic school 38 or operated pursuant to a service contract with a school district for trans- 39 porting children to or from school or in connection with school approved 40 activities, the annual fee shall be twenty-four dollars ($24.00). 41 (3) For all motorcycles and all-terrain vehicles operated upon the public 42 highways the annual fee shall be nine dollars ($9.00). For operation of an 43 all-terrain vehicle or motorcycle off the public highways, the fee specified 2 1 in section 67-7122, Idaho Code, shall be paid. Registration exemptions pro- 2 vided in section 49-426(2) and (3), Idaho Code, apply to all-terrain vehicles 3 and motorcycles used for the purposes described in subsections (2) and (3) of 4 section 49-426, Idaho Code. 5 (4) For all motor homes the fee shall be as specified in subsection (1) 6 of this section and shall be in addition to the fees provided for in section 7 49-445, Idaho Code. 8 (5) Registration fees shall not be subject to refund. 9 (6) A financial institution or repossession service contracted to a 10 financial institution repossessing vehicles under the terms of a security 11 agreement shall move the vehicle from the place of repossession to the finan- 12 cial institution's place of business on a repossession plate. The repossession 13 plate shall also be used for demonstrating the vehicle to a prospective pur- 14 chaser for a period not to exceed ninety-six (96) hours. The registration fees 15 for repossession plates shall be as required in subsection (1) of this section 16 for a vehicle one (1) and two (2) years old. All other fees required under 17 chapter 4, title 49, Idaho Code, shall be in addition to the registration fee. 18 The repossession plate shall be issued on an annual basis by the department. 19 (7) In addition to the annual registration fee in this section, there 20 shall be an initial program fee of twenty-five dollars ($25.00) and an annual 21 program fee of fifteen dollars ($15.00) for all special license plate programs 22 for those license plates issued pursuant to sections 49-404A, 49-407, 49-408, 23 49-409, 49-414, 49-416 and 49-418, Idaho Code. For special plates issued pur- 24 suant to sections 49-406 and 49-406A, Idaho Code, there shall be an initial 25 program fee of twenty-five dollars ($25.00) but there shall be no annual 26 renewal fee. For special plates issued pursuant to sections 49-417, 49-417A, 27 49-417B, 49-417C, 49-418A, 49-418B, 49-418C, 49-419, 49-419A, 49-419C, 49-420, 28 49-420A, 49-420B,and49-420C, 49-420D and 49-420E, Idaho Code, there shall be 29 an initial program fee of thirty-five dollars ($35.00) and an annual program 30 fee of twenty-five dollars ($25.00). The fees contained in this subsection 31 shall be applicable to all new special plate programs. The initial program fee 32 and the annual program fee shall be deposited in the state highway account and 33 shall be used to fund the cost of administration of special license plate pro- 34 grams, unless otherwise specified by law. 35 SECTION 2. That Chapter 4, Title 49, Idaho Code, be, and the same is 36 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 37 ignated as Section 49-419C, Idaho Code, and to read as follows: 38 49-419C. IDAHO WHITE WATER PLATES. (1) On and after January 1, 2004, any 39 person who is the owner of a vehicle registered under the provisions of sec- 40 tion 49-402, Idaho Code, or registered under any other section of law for 41 which the purchase of special plates is allowed, may apply for and, upon 42 department approval, receive special Idaho white water license plates in lieu 43 of regular license plates. The provisions of this section shall not apply to 44 any vehicle with a registered maximum gross weight over twenty-six thousand 45 (26,000) pounds. Availability of Idaho white water license plates for other 46 vehicles shall be subject to the rules, policies and procedures of the depart- 47 ment. 48 (2) In addition to the regular registration fee required in chapter 4, 49 title 49, Idaho Code, the applicant shall be charged a fee of thirty-five dol- 50 lars ($35.00) for the initial issuance of plates, and twenty-five dollars 51 ($25.00) upon each succeeding annual registration. Ten dollars ($10.00) of the 52 initial fee and ten dollars ($10.00) of the renewal fee shall be deposited in 53 the state highway account and shall be used to fund the cost of administration 3 1 of this special license plate program. Twenty-five dollars ($25.00) of each 2 initial fee and fifteen dollars ($15.00) of each renewal fee shall be trans- 3 ferred by the state treasurer for deposit to the tourism and promotion fund of 4 the department of commerce, and shall be used by the department of commerce 5 for the general education and promotion of Idaho's white water rivers and 6 industries. The department of commerce shall confer with the consulting panel 7 representing white water river communities and industries before expending any 8 moneys from the fund that were received into the fund from revenue derived 9 from this special license plate program. 10 (3) Whenever title or interest in a vehicle registered under the provi- 11 sions of this section is transferred or assigned, the owner may transfer the 12 special plates to another vehicle upon payment of the required transfer fees. 13 The owner may only display the plates on another vehicle upon receipt of the 14 new registration from the department. 15 (4) The Idaho white water license plate shall be of a color and design in 16 accordance with the provisions of section 49-402C, Idaho Code. The design and 17 any slogan on the plate shall be acceptable to the department of commerce and 18 the consulting panel representing Idaho's white water river communities and 19 industries, and shall be approved by the Idaho transportation department uti- 20 lizing a numbering system as determined by the department. Initial costs of 21 the plate program, including costs of plate design, shall be paid by the 22 department of commerce. Not more than fifteen percent (15%) of all revenues 23 made available to the department of commerce from the sale and renewal of 24 Idaho white water license plates shall be used by the department of commerce 25 to pay for the costs of the plate design and for those administrative expenses 26 necessarily incurred by operation of the general education and promotion pro- 27 gram. 28 (5) Sample Idaho white water license plates may be purchased for a fee of 29 thirty dollars ($30.00), ten dollars ($10.00) of which shall be deposited in 30 the state highway account and twenty dollars ($20.00) of which shall be trans- 31 ferred to the tourism and promotion fund of the department of commerce and 32 shall be used for the general education and promotion of Idaho's white water 33 rivers and industries. No additional fee shall be charged for personalizing 34 sample plates. 35 SECTION 3. This act shall be in full force and effect on and after Janu- 36 ary 1, 2004.
STATEMENT OF PURPOSE RS 12678 In recognition of the role the white water community and associated industry plays in the promotion of tourism in the state of Idaho, this amendment to the Idaho Code establishes a special license plate program to promote Idaho as a tourist destination for white water enthusiasts. A committee of individuals made up of outfitters and advocates of the white water community, together with the Department of Commerce, will work together using the proceeds garnered from the sale of this special license plate for the general promotion and education of Idaho s white water rivers and industries. A white water license plate would allow members of the white water community, and other Idahoans, to promote Idaho rivers and spread awareness about this unique feature of Idaho s outdoor experience.
