|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE SENATE SENATE BILL NO. 1051 BY COMMERCE AND HUMAN RESOURCES COMMITTEE 1 AN ACT 2 RELATING TO INSURANCE CONTRACTS; AMENDING CHAPTER 18, TITLE 41, IDAHO CODE, BY 3 THE ADDITION OF A NEW SECTION 41-1845, IDAHO CODE, TO SPECIFY UNFAIR METH- 4 ODS OF COMPETITION AND UNFAIR OR DECEPTIVE ACTS OR PRACTICES. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Chapter 18, Title 41, Idaho Code, be, and the same is 7 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 8 ignated as Section 41-1845, Idaho Code, and to read as follows: 9 41-1845. UNFAIR METHODS OF COMPETITION AND UNFAIR OR DECEPTIVE ACTS OR 10 PRACTICES. The following are defined as unfair methods of competition and 11 unfair or deceptive acts or practices in the business of insurance: 12 (1) Denying health care coverage to any individual based solely on that 13 individual's casual or nonprofessional participation in the following activi- 14 ties: motorcycling, snowmobiling, off-highway vehicle riding, skiing, 15 snowboarding, horseback riding or similar activities; or 16 (2) Excluding medical benefits under health care coverage to any covered 17 individual based solely on that individual's casual or nonprofessional partic- 18 ipation in the following activities: motorcycling, snowmobiling, off-highway 19 vehicle riding, skiing, snowboarding, horseback riding or similar activities.

NO. 1051 1 AMENDMENT TO SECTION 1 2 On page 1 of the printed bill, delete lines 9 through 19 and insert: 3 "41-1845. RECREATIONAL-RELATED ACTIVITIES. (1) No company providing 4 health insurance benefits may: 5 (a) Deny health care coverage to any individual based solely on that 6 individual's casual or nonprofessional participation in the following 7 activities: motorcycling, snowmobiling, off-highway vehicle riding, ski- 8 ing, snowboarding, horseback riding or similar activities; or 9 (b) Exclude medical benefits under health care coverage to any covered 10 individual based solely on that individual's casual or nonprofessional 11 participation in the following activities: motorcycling, snowmobiling, 12 off-highway vehicle riding, skiing, snowboarding, horseback riding or sim- 13 ilar activities. 14 (2) Nothing in this section shall preclude, alter or otherwise affect the 15 subrogation rights of companies providing health insurance benefits.". 16 CORRECTION TO TITLE 17 On page 1, in line 3, delete "UNFAIR METH-", delete line 4 and insert: 18 "BENEFITS FOR RECREATIONAL-RELATED ACTIVITIES.".

STATEMENT OF PURPOSE RS 12439C1 This legislation defines as an unfair method of competition and an unfair or deceptive act or practice in the business of insurance the denial of health care coverage to any individual, or the exclusion of medical benefits under health care coverage to any covered individual, based solely on that individual s casual or nonprofessional participation in skiing, snowboarding, off-highway vehicle riding, or horseback riding, motorcycling, snowmobiling or similar activities.
