|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE SENATE SENATE BILL NO. 1069 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO BEER AND WINE AND RESTRICTIONS CONCERNING AGE; AMENDING SECTION 3 23-943, IDAHO CODE, TO PROVIDE THAT PERSONS WHO ARE EIGHTEEN YEARS OF AGE 4 OR OLDER MAY, ON PREMISES LICENSED FOR THE SALE OF BEER OR WINE ONLY FOR 5 CONSUMPTION OFF THE LICENSED PREMISES, SELL, POSSESS OR DELIVER BEER OR 6 WINE IN THE COURSE OF THEIR EMPLOYMENT; AND AMENDING SECTION 23-1013, 7 IDAHO CODE, TO PROVIDE THAT ANY PERSON WHO IS EIGHTEEN YEARS OF AGE OR 8 OLDER MAY, ON PREMISES LICENSED FOR THE SALE OF BEER ONLY FOR CONSUMPTION 9 OFF THE LICENSED PREMISES, SELL, POSSESS OR DELIVER BEER IN THE COURSE OF 10 HIS EMPLOYMENT. 11 Be It Enacted by the Legislature of the State of Idaho: 12 SECTION 1. That Section 23-943, Idaho Code, be, and the same is hereby 13 amended to read as follows: 14 23-943. PERSONS UNDER SPECIFIED AGES FORBIDDEN TO ENTER, REMAIN IN OR 15 LOITER AT CERTAIN LICENSED PLACES. No person under the age of twenty-one (21) 16 years shall enter, remain in or loiter in or about any place, as herein 17 defined, licensed for the sale of liquor by the drink at retail, or sale of 18 beer for consumption on the premises; nor shall any licensee of either such 19 place, or any person in charge thereof, or on duty while employed by the 20 licensee therein, permit or allow any person under the age specified with 21 respect thereto to remain in or loiter in or about such place. 22 Provided, however, it is lawful for persons who are musicians and singers 23 eighteen (18) years of age or older, to enter and to remain in any place as 24 defined in section 23-942, Idaho Code, but only during and in the course of 25 their employment as musicians and singers. Provided further, that it is lawful 26 for persons who are nineteen (19) years of age or older to sell, serve, pos- 27 sess or dispense liquor, beer or wine in the course of their employment in any 28 place as defined in section 23-942, Idaho Code, or in any other place where 29 liquor, beer or wine are lawfully present, so long as such place is the place 30 of employment for such person under twenty-one (21) years of age. However the 31 foregoing shall not permit the sale or distribution of any alcoholic beverages 32 to any person under the ages specified for sale of alcoholic beverages. 33 Provided further, persons who are eighteen (18) years of age or older may, 34 on premises licensed for the sale of beer or wine only for consumption off the 35 licensed premises, sell, possess or deliver beer or wine in the course of 36 their employment. 37 SECTION 2. That Section 23-1013, Idaho Code, be, and the same is hereby 38 amended to read as follows: 39 23-1013. RESTRICTIONS CONCERNING AGE. Any person who is nineteen (19) 40 years of age or older may sell, serve, possess or dispense beer in the course 41 of his employment,; provided however, any person who is eighteen (18) years of 2 1 age or older may, on premises licensed for the sale of beer only for consump- 2 tion off the licensed premises, sell, possess or deliver beer in the course of 3 his employment. Ootherwise it shall be unlawful for any person to sell, serve 4 or dispense beer to or by any person under twenty-one (21) years of age, proof 5 of which, shall be a validly issued state, district, territorial, possession, 6 provincial, national or other equivalent government driver's license, identi- 7 fication card or military identification card bearing a photograph and date of 8 birth, or a valid passport.
STATEMENT OF PURPOSE RS 12921 The objective of this legislation is to change the age by which the employees of retailers may sell beer and wine from the age of nineteen to eighteen. This legislation will allow any person who is eighteen years of age or older to sell beer or wine in the course of his employment. FISCAL IMPACT There is no projected fiscal impact from this change.
