1 AN ACT
2 RELATING TO OUTREACH EFFORTS; AMENDING CHAPTER 2, TITLE 56, IDAHO CODE, BY THE
3 ADDITION OF A NEW SECTION 56-209m, IDAHO CODE, TO PROVIDE THAT OUTREACH
4 EFFORTS RELATED TO THE FEDERAL CHILDREN'S HEALTH INSURANCE PROGRAM MAY
5 EXCEED FEDERAL MINIMUM LEVELS AND TO PROVIDE THAT SUCH EFFORTS SHALL BE
6 SUBJECT TO STATE BUDGETARY LIMITATIONS THAT OTHERWISE APPLY.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. That Chapter 2, Title 56, Idaho Code, be, and the same is
9 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
10 ignated as Section 56-209m, Idaho Code, and to read as follows:
11 56-209m. OUTREACH EFFORTS. Notwithstanding any other provision of law to
12 the contrary, the department of health and welfare's outreach efforts related
13 to the federal title XXI children's health insurance program may exceed the
14 minimum level allowed by federal law; provided however, that such outreach
15 efforts shall be subject to any state budgetary limitations that otherwise
16 apply to the program.
STATEMENT OF PURPOSE
This bill provides authority to the Department of Health & Welfare to
allow outreach, including media, for the Children s Health Insurance
Program (CHIP) . Legislative intent language in the 2001 Health & Welfare
appropriation law restricted CHIP outreach to the minimum required by
federal law. While that language was removed in the 2002 CHIP funding
law, the Department of Health & Welfare requires authority to reinstate
the previous CHIP outreach program. This bill specifically restates the
original intent of the legislature to allow funds for outreach as long
as CHIP funding does not exceed the current funding cap.
There is no fiscal impact to the General Fund. Total funds expended on
CHIP are currently governed by a cap of $3.8 million dollars. This bill
allows for outreach from current budgeted funds as long as total
expenditures do not exceed the mandated cap.
