|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE SENATE SENATE BILL NO. 1079 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO THE LOCAL HIGHWAY TECHNICAL ASSISTANCE COUNCIL; AMENDING SECTION 3 40-2401, IDAHO CODE, TO PROVIDE THAT SERVICES PERFORMED BY COUNCIL MEMBERS 4 MAY BE COMPENSATED AT A RATE NOT TO EXCEED ONE HUNDRED DOLLARS PER DAY AS 5 DETERMINED BY THE MEMBERS' RESPECTIVE ASSOCIATIONS AND TO DELETE CERTAIN 6 STATUTORY LIMITS ON REIMBURSEMENT OF COUNCIL MEMBERS FOR ACTUAL AND NECES- 7 SARY EXPENSES. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 40-2401, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 40-2401. LOCAL HIGHWAY TECHNICAL ASSISTANCE COUNCIL. (1) A local highway 12 technical assistance council is hereby created. The council shall be a public 13 agency, and is the instrumentality of its member jurisdictions. The council 14 and its officers and employees shall not be subject to the administrative or 15 management control of the Idaho transportation department. 16 (2) The council shall consist of nine (9) members, three (3) each to be 17 appointed by the association of Idaho cities, Idaho association of counties, 18 and the Idaho association of highway districts. Council members shall serve at 19 the pleasure of the appointing authority. 20 (3) Members of the council may be entitled to compensation for services 21 atthea rateof fiftynot to exceed one hundred dollars ($50.100) per day as 22 determined by the members' respective associations and actual and necessary 23 expenses, subject to the limits as provided in section 67-2008, Idaho Code, if24not otherwise compensated by the appointing authority. Payment of an honorari- 25 um as provided in this subsection shall not be considered salary as defined in 26 section 59-1302(31), Idaho Code. Compensation and reimbursement shall be made 27 from the local highway technical assistance council accounts established in 28 section 40-717, Idaho Code.
STATEMENT OF PURPOSE RS 12616 C1 This legislation amends from Title 40, chapter 24 the reference to compensating members of the Local Highway Technical Assistance Council $50.00 per day of service subject to the limitations as provided in Title 67, chapter 2008. The amended language allows the associations; The Idaho Association of Counties, The Association of Idaho Cities, and the Idaho Association of Highway Districts to set the amount of compensation not to exceed $100.00 per day for their representatives on this council.
