|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE SENATE SENATE BILL NO. 1112 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE STATE MILITIA; AMENDING SECTION 46-605, IDAHO CODE, TO PROVIDE 3 THAT OFFICERS AND ENLISTED PERSONNEL IN ACTIVE SERVICE OF THE STATE MAY 4 ACCEPT, IN LIEU OF CERTAIN PAY ENTITLEMENTS, GREATER PAY AND ALLOWANCES 5 AVAILABLE FROM OTHER GOVERNMENT DEPARTMENTS OR AGENCIES. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 46-605, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 46-605. PAY ON ACTIVE DUTY. When the national guard or any part thereof 10 is ordered on active duty in the service of the state, the enlisted personnel, 11 the commissioned officers and warrant officers so ordered shall be entitled to 12 pay of fifty-five dollars ($55.00) per day or shall be entitled to the same 13 pay as enlisted personnel, officers and warrant officers of like grade and 14 length of service in the armed forces of the United States, whichever sum is 15 greater, and they shall be entitled to the same allowances as enlisted person- 16 nel, officers and warrant officers of like grade and length of service in the 17 armed forces of the United States. All payments of pay and allowances under 18 this section shall be made by the adjutant general. No deductions shall be 19 made from the pay of officers or enlisted personnel in active service of the 20 state for dues or other financial obligations imposed by any bylaw, rules or 21 regulations of a civil character. When lodging or meals, or both, cannot be 22 provided by the state, the adjutant general may pay a per diem in addition to 23 the pay and allowances. Nothing in this section shall preclude officers or 24 enlisted personnel in active service of the state from accepting, in lieu of 25 the pay entitlement provided above, greater pay and allowances that may be 26 available from any other government department or agency through cooperative 27 agreement or otherwise.
STATEMENT OF PURPOSE RS 12968 This proposal modifies the existing I.C. S 46-605, to allow members of the state militia when serving on state active duty to waive pay at the state active duty rate and accept greater pay when available from and provided by other government sources.
