2 RELATING TO THE REGIONAL PUBLIC TRANSPORTATION AUTHORITY ACT; AMENDING SECTION
3 40-2104, IDAHO CODE, TO CLARIFY THAT A REGIONAL PUBLIC TRANSPORTATION
4 AUTHORITY IS A POLITICAL SUBDIVISION OF THE STATE; AND AMENDING SECTION
5 40-2112, IDAHO CODE, TO PROVIDE FOR POSTING NOTICE OF THE BUDGET HEARING
6 IN AT LEAST ONE CONSPICUOUS PLACE IN EACH COUNTY WITHIN THE BOUNDARIES OF
7 THE REGIONAL PUBLIC TRANSPORTATION AUTHORITY AND AT THE ADMINISTRATIVE
8 OFFICES OF THE REGIONAL PUBLIC TRANSPORTATION AUTHORITY.
9 Be It Enacted by the Legislature of the State of Idaho:
10 SECTION 1. That Section 40-2104, Idaho Code, be, and the same is hereby
11 amended to read as follows:
12 40-2104. PURPOSE OF AUTHORITY. The purpose of an authority created pursu-
13 ant to this chapter is to establish a single governmental agency oriented
14 entirely toward public transportation needs within each county or region that
15 deems such an agency necessary. This authority, a political subdivision of the
16 state of Idaho, is under the supervision of and directly responsible to local
17 governments, and shall provide public transportation services, encourage pri-
18 vate transportation programs and coordinate both public and private transpor-
19 tation programs, services and support functions.
20 SECTION 2. That Section 40-2112, Idaho Code, be, and the same is hereby
21 amended to read as follows:
22 40-2112. BUDGET. (1) The board shall annually adopt a budget and cause a
23 public hearing to be held upon the budget.
24 (2) Notice of the budget hearing shall be posted at least ten (10) days
25 prior to the date of the meeting in at least one (1) conspicuous place in
26 each county, city and highway district within the region boundaries of the
27 regional public transportation authority and at the administrative offices of
28 the regional public transportation authority. A copy of the notice shall also
29 be published in accordance with the provisions of section 40-206, Idaho Code.
30 The place, hour and day of the hearing shall be specified in the notice, as
31 well as the place where the budget may be examined prior to the hearing. A
32 full and complete copy of the proposed budget shall be published with and as a
33 part of the publication of the notice of hearing.
34 (3) The budget shall be available for public inspection from and after
35 the date of the posting of notice of hearing at a place and during business
36 hours as the board may direct.
37 (4) A quorum of the board shall attend the hearing and explain the pro-
38 posed budget and hear any and all objections to it.
39 (5) The budget shall be completed and finalized not later than the Tues-
40 day following the first Monday in September for the ensuing fiscal year.
41 (6) The fiscal year of the authority shall commence on the first day of

1 October of each year.
STATEMENT OF PURPOSE
RS 12961
This legislation amends the Idaho code sections governing a
Regional Public Transportation Authority (RPTA). It provides
that an RPTA is a political subdivision of the state, thus making
it clear that it is a governmental agency for the purposes of
tort liability. The legislation also amends the posting
requirements to provide that annual budgets be posted within the
boundaries of the counties within the RPTA as well as at the
administrative offices of the RPTA.
