                            SENATE CONCURRENT RESOLUTION NO. 106

  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING A CERTAIN RULE OF THE  STATE
  3        BOARD  OF  EDUCATION RELATING TO RULES GOVERNING ADMINISTRATION AND FEDER-
  4        ALLY FUNDED PROGRAMS.
                                                                        
  5    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  6        WHEREAS, the Legislature is vested  with  authority  to  reject  executive
  7    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
  8    that  the Legislature finds that the rules are not consistent with legislative
  9    intent; and
 10        WHEREAS, it is the finding of the Legislature that a certain rule  of  the
 11    State  Board of Education  relating to rules governing administration and fed-
 12    erally funded programs is not consistent with legislative intent and should be
 13    rejected.
 14        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
 15    of the Fifty-seventh Idaho Legislature, the Senate and the House of  Represen-
 16    tatives  concurring therein, that IDAPA 08.02.01, Section 100, a final rule of
 17    the State Board of Education  relating to rules governing  administration  and
 18    federally  funded  programs, previously adopted as a pending rule under Docket
 19    Number 08-0201-9602, be, and the same is hereby rejected  and  declared  null,
 20    void and of no force and effect.

Statement of Purpose / Fiscal Impact


                      STATEMENT OF PURPOSE
                                
                            RS 13049

This concurrent resolution would reject a final rule of the State
Board of Education relating to rules governing administration and
federally funded programs.  The effect of this resolution, if
adopted by both houses, would be to prevent the agency rule from
remaining in effect beyond the date of the legislative action.
