                            SENATE CONCURRENT RESOLUTION NO. 108
                                                                        
                              BY JUDICIARY AND RULES COMMITTEE
                                                                        
  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE  AND  REJECTING  A  CERTAIN  RULE  OF  THE
  3        DEPARTMENT  OF  HEALTH  AND WELFARE RELATING TO ELIGIBILITY FOR AID TO THE
  4        AGED, BLIND AND DISABLED AND CONCERNING REBUTTABLE PRESUMPTION.
                                                                        
  5    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  6        WHEREAS, the Legislature is vested  with  authority  to  reject  executive
  7    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
  8    that  the Legislature finds that the rules are not consistent with legislative
  9    intent; and
 10        WHEREAS, it is the finding of the Legislature that a certain rule  of  the
 11    Department  of Health and Welfare relating to eligibility for aid to the aged,
 12    blind and disabled and concerning rebuttable  presumption  is  not  consistent
 13    with legislative intent and should be rejected.
 14        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
 15    of  the Fifty-seventh Idaho Legislature, the Senate and the House of Represen-
 16    tatives concurring therein, that IDAPA 16.03.05, Section 831,  Subsection  01,
 17    a rule of the Department of Health and Welfare relating to eligibility for aid
 18    to the aged, blind and disabled and concerning rebuttable presumption, adopted
 19    as a pending rule under Docket Number 16-0305-0202, be, and the same is hereby
 20    rejected and declared null, void and of no force and effect.

Statement of Purpose / Fiscal Impact


                      STATEMENT OF PURPOSE
                                
                            RS 13064

This concurrent resolution would reject a pending rule of the
Department of Health and Welfare relating to eligibility for aid
to the aged, blind and disabled and concerning rebuttable
presumption.  The effect of this resolution, if adopted by both
houses, would be to prevent the agency rule from going into
effect.
