S1296|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1296 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO LICENSE FEES TO PRACTICE LAW; AMENDING SECTION 3-409, IDAHO CODE, 3 TO INCREASE LICENSE FEES OF THE IDAHO STATE BAR AND TO MAKE TECHNICAL COR- 4 RECTIONS. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 3-409, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 3-409. LICENSE FEES AND APPROPRIATIONS. Every person practicing, or hold- 9 ing himself out as practicing law within this state, or holding himself out to 10 the public as a person qualified to practice or carry on the calling of a law- 11 yer within this state, except state and United States judges of the courts of 12 record within this state, shall, prior to so doing and no later than13January 10February 1 of each year, commencing with14the year 1990, and thereafter,pay to the board of commissioners of the 15 IdahoSs tateBb ar as a 16 license fee thesum of sixty-five dollars ($65.00)follow- 17 ing amounts: 18 For the year 1999: Ffor the calendar year ofhis19admission to the practice of law in the state 20 of Idaho if admitted prior to July 1 :of the calendar year21and thirty-fiveone hundred dollars ($35.221 00) ; For the calendar year of admission to the prac- 23 tice of law in the state of Idaho if admitted after July 1 : 24of the calendar year and one hundred twenty-five25 sixty dollars ($12560.00 ) ; E 26each year for the next three (3) calendar years following 27 the calendar year ofsuchadmission :, and28two hundredfiftyfive dollars ($25290 5 ) ;for eE ach year 30thereafter, untilafter the third full year of admission: 31 two hundred seventy-five dollars ($275); Each year following the calen- 32 dar yearfollowingof the lawyer's seventy-second 33 birthday :and for such calendar year and each year thereaf-34ter, the sum of forty-fivefifty dollars ($4355 0 .00).; Affiliate members36shall pay a fee of ninety-fivefor each calendar year: one hun- 37 dred five dollars ($910 5.0038) .per year.39 For the year 2000 and each year thereafter: For the calendar year of 40 admission to the practice of law in the state of Idaho if admitted prior to 41 July 1: one hundred fifteen dollars ($115); For the calendar year of admission 42 to the practice of law in the state of Idaho if admitted after July 1: sixty- 43 five dollars ($65.00); Each year for the next three (3) calendar years follow- 2 1 ing the calendar year of admission: two hundred thirty dollars ($230); Each 2 year after the third full year of admission three hundred fifteen dollars 3 ($315); Each year following the calendar year of the lawyer's seventy-second 4 birthday: fifty-five dollars ($55.00); Affiliate members for each calendar 5 year one hundred twenty dollars ($120). 6 The moneys thus collected, together with other revenues shall be adminis- 7 tered under the direction of the board of commissioners of the IdahoS8s tateBb ar for the purpose of 9 administering the IdahoSs tateBb 10 ar, encouraging local bar associations, promoting legal education semi- 11 nars, fostering relations between the public and the bar and for the purpose 12 of establishing and maintaining a clients' security fund which shall be admin- 13 istered by the IdahoSs tateBb 14 ar commissioners under rules approved by theSs 15 upremeCc ourt, provided that the clients' 16 security fund shall be funded by assessment of the members of the Idaho17Ss tateBb ar not to exceed ten 18 dollars ($10.00) per member per year, independent of the license fee. All 19 moneys received and expended by the commissioners of the IdahoS20s tateBb ar shall be audited annu- 21 ally by a certified public accountant.
RS-07521 Statement of Purpose This bill raises the license fees paid by Idaho lawyers. The licenses fees would be changed as follows: Lawyer Status Current 19992000-on Year of Admission (Admitted before 7/1) $65.00 $ 100.00 $ 115.00 Year of Admission (admitted after 7/1) $35.00 $60.00 $65.00 First Three Full Years of Practice $125.00 $205.00 $230.00 More Than Three Years in Practice $250.00 $275.00 $315.00 Affiliate $95.00 $105.00 $120.00 Over 72 Years Old $45.00 $50.00 $55.00 The bill also changes the due date for payment of fees from January 10 to February 1. The purpose of the bill is to meet projected increases in the cost of administering the regulatory functions of the Idaho State Bar. This matter was presented to Idaho lawyers for a vote in November, 1997, and was approved by a 59% majority. The last dues increase was made in 1990. The proposed increase is phased in over a two-year period. Even with the increase Idaho's fees are representative of those in the Western United States. Fiscal Impact None. The Idaho State Bar uses no tax dollars and is entirely self-funded. S 1296
