 1                                        AN ACT
 2    RELATING TO LICENSING OF ELECTRICIANS; AMENDING SECTIONS 54-1002 AND  54-1003,
 3        IDAHO  CODE,  TO  PROVIDE  CURRENT TERMINOLOGY RELATING TO MASTER ELECTRI-
 4        CIANS; AMENDING SECTION 54-1003A, IDAHO CODE, TO PROVIDE CURRENT TERMINOL-
 5        OGY RELATING TO MASTER ELECTRICIANS AND  TO  MAKE  TECHNICAL  CORRECTIONS;
 6        AMENDING SECTIONS 54-1005 AND 54-1007, IDAHO CODE, TO PROVIDE CURRENT TER-
 7        MINOLOGY  RELATING  TO  MASTER ELECTRICIANS; AND AMENDING SECTION 54-1014,
 8        IDAHO CODE, TO PROVIDE CURRENT TERMINOLOGY RELATING TO MASTER ELECTRICIANS
 9        AND TO REDUCE THE FEE FOR MASTER ELECTRICIAN LICENSE RENEWAL.

10    Be It Enacted by the Legislature of the State of Idaho:

11        SECTION 1.  That Section 54-1002, Idaho Code, be, and the same  is  hereby
12    amended to read as follows:

13        54-1002.  LICENSE  ESSENTIAL  TO ENGAGE IN BUSINESS -- LICENSURE AUTHORITY
14    EXCLUSIVE TO THE STATE. (1) It shall be unlawful for any person,  partnership,
15    company,  firm,  association  or corporation, to act, or attempt to act, as an
16    electrical contractor in this state until such person,  partnership,  company,
17    firm, association or corporation, shall have received a license as an electri-
18    cal  contractor,  as herein defined, issued pursuant to the provisions of this
19    chapter by the administrator of the division of building safety.
20        (2)  It shall be unlawful for any person to act as a  journeyman  electri-
21    cian  in this state until such person shall have received a license as a jour-
22    neyman electrician, as herein defined, issued pursuant to  the  provisions  of
23    this  act,  by the administrator of the division of building safety, provided,
24    however, that any person who has been issued a master  journeyman  
25    electrician's  license  pursuant to this chapter may act as a journeyman elec-
26    trician.
27        (3)  Licensure of electrical contractors and journeyman electricians shall
28    be within the exclusive jurisdiction of the state pursuant to this chapter and
29    no local jurisdiction shall have the authority to require additional licensure
30    or to issue licenses to persons licensed under this chapter which  are  incon-
31    sistent  with the provisions of this chapter or rules promulgated by the divi-
32    sion of building safety. The state shall investigate all local infractions and
33    state violations of this chapter and prosecute the same. The  local  jurisdic-
34    tions  will  assist the state by requesting investigations within their juris-
35    dictions. Nothing in this chapter shall restrict a city or county from  impos-
36    ing stricter public safety rules, notwithstanding any provision of Idaho Code.

37        SECTION  2.  That  Section 54-1003, Idaho Code, be, and the same is hereby
38    amended to read as follows:

39        54-1003.  ADMINISTRATOR AUTHORIZED TO ISSUE LICENSE. Only the  administra-
40    tor of the division of building safety of the state of Idaho is authorized and
41    empowered  to  conduct  examinations  and  to  pass upon the qualifications of

 1    applicants, and to grant and issue licenses to such applicants as are found to
 2    be qualified to engage in the trade, business or calling of a journeyman elec-
 3    trician or electrical contractor or master  journeyman  electrician
 4    in the manner and upon the  terms  and  conditions  hereinafter  provided.  No
 5    licenses  granted  hereunder  shall  be transferable. Licenses shall be issued
 6    upon the condition that the holder thereof shall comply with all provisions of
 7    this chapter.

 8        SECTION 3.  That Section 54-1003A, Idaho Code, be, and the same is  hereby
 9    amended to read as follows:

10        54-1003A.  DEFINITIONS.  (1)  Electrical Contractor. Except as provided in
11    section 54-1016, Idaho Code, any person, partnership, company, firm,  associa-
12    tion  or  corporation  engaging in, conducting, or carrying on the business of
13    installing wires or equipment to carry electric current or installing  appara-
14    tus  to  be  operated  by such current, or entering into agreements to install
15    such wires, equipment or apparatus, shall for the purpose of this act be known
16    as an electrical contractor.
17        (2)  Journeyman Electrician. Except as provided in section 54-1016,  Idaho
18    Code,  and   part   subsections ( 3 ),  
19    and part   ( 4 ) and (5)   of  this  section,  any
20    person  who  personally  performs  or  supervises  the actual physical work of
21    installing electric wiring or equipment to convey electric current, or appara-
22    tus to be operated by such current, shall, for the purpose  of  this  act,  be
23    known as a journeyman electrician.
24        (3)  Apprentice  Electrician.  Any person who, for the purpose of learning
25    the trade of journeyman electrician, engages in the installation  of  electric
26    wiring,  equipment,  or apparatus while under the constant on-the-job supervi-
27    sion of a qualified journeyman electrician shall, for the purpose of this act,
28    be known as an apprentice electrician.
29        (4)  Maintenance Electrician. Any person who is regularly employed to ser-
30    vice, maintain or repair electrical apparatus, or to  make  minor  repairs  or
31    alterations   to  existing  electrical  wires  or  equipment  located  on  his
32    employer's premises shall, for the purpose of this act, be known as a  mainte-
33    nance electrician.
34        (5)  Master  Journeyman  Electrician. A person who has the nec-
35    essary  qualifications,  training, experience and technical knowledge to plan,
36    layout or design the installation of electrical wiring  or  equipment,  or  to
37    supervise  such  planning,  layout,  or design, and who performs or supervises
38    such planning, layout or design, shall, for the purpose of this act, be  known
39    as a master  journeyman  electrician.

40        SECTION  4.  That  Section 54-1005, Idaho Code, be, and the same is hereby
41    amended to read as follows:

42        54-1005.  RULES -- INSPECTIONS -- INSPECTION TAGS AND FEES. (1) The admin-
43    istrator of the division of building safety is hereby authorized and  directed
44    to  enforce  rules consistent with this act for the administration of this act
45    and to effectuate the purposes thereof, and for the  licensing  of  electrical
46    contractors  and the examination and licensing of journeyman electricians, and
47    the  examination   and   licensing   of   master      journeyman   
48    electricians  ,    and to set by rule the fee for master jour-
49    neyman electrician licenses,  and  to  make  inspections  of  electrical
50    installations referred to in section 54-1001, Idaho Code, and to issue inspec-
51    tion  tags  covering  such  installations, and to collect the fees established

 1    therefor.
 2        (2)  Individuals, firms,  cooperatives,  corporations,  or  municipalities
 3    selling  electricity,  hereinafter known as the power supplier, shall not con-
 4    nect with or energize any electrical installation, coming under the provisions
 5    of this act, unless the owner or a licensed electrical contractor  has  deliv-
 6    ered  to  the  power  supplier an inspection tag, issued by the administrator,
 7    covering the installation to be energized. Immediately after  an  installation
 8    has  been  energized, the power supplier shall deliver to the administrator or
 9    his authorized agent, the inspection tag covering such installation.
10        (3)  It shall be unlawful for  any  person,  partnership,  company,  firm,
11    association  or corporation other than a power supplier, to energize any elec-
12    trical installation coming under the provisions of this act unless an applica-
13    tion for an electrical inspection tag, covering  such  installation,  together
14    with the inspection fee herein provided, has been forwarded to the administra-
15    tor.

16        SECTION  5.  That  Section 54-1007, Idaho Code, be, and the same is hereby
17    amended to read as follows:

18        54-1007.  ISSUANCE OF LICENSES -- RECIPROCITY. (1) The administrator shall
19    issue licenses to such persons as have by examination shown themselves  to  be
20    fit, competent and qualified to engage in the trade of journeyman electrician,
21    or  master    journeyman   electrician, and to such persons, firms,
22    partnerships, associations or corporations as have shown themselves to be fit,
23    competent and qualified to engage in the business of  electrical  contracting.
24    Any  person  who  has  worked  as a journeyman electrician or as an apprentice
25    electrician, as herein defined, for a period of not less than four (4)  years,
26    shall  be  considered  as  qualified  to  apply for a journeyman electrician's
27    license in this state, provided that for each such year he is claiming to have
28    worked as an apprentice electrician, the apprentice registered with the  divi-
29    sion of building safety as an apprentice, paid an apprentice registration fee,
30    and  submitted with his annual application for apprentice registration verifi-
31    cation of employment and hours worked. The electrical board may, by rule,  fix
32    the apprentice registration fee, in an amount not to exceed the costs of issu-
33    ing  apprentice  registration certificates and enforcing the apprentice regis-
34    tration provisions of this act, and may also by  rule  establish  requirements
35    relative  to the manner of verification of employment and hours worked. Before
36    such experience as an apprentice may be considered as qualifying  the  appren-
37    tice  to  take the journeyman's examination, the apprentice must also complete
38    the required related instruction for electrical apprentices as approved by the
39    Idaho state board for vocational education. Any person who has worked in  this
40    state  for a period of not less than two (2) years as a journeyman electrician
41    shall be considered as qualified to apply for a master  journeyman 
42    electrician's license in this state.
43        (2)  To the extent that other states which provide for  the  licensing  of
44    electricians provide for similar action, the administrator, on the recommenda-
45    tion  of  the  Idaho  electrical  board,  may  grant  licenses to electricians
46    licensed by such other states, upon payment by the applicant of  the  required
47    fee  and  upon furnishing proof to the board that the applicant has qualifica-
48    tions at least equal to those provided herein for applicants for written exam-
49    inations. Applicants who qualify for a license under this subsection  are  not
50    required to take a written examination.

51        SECTION  6.  That  Section 54-1014, Idaho Code, be, and the same is hereby
52    amended to read as follows:

 1        54-1014.  FEES. The following fees shall be charged by  the  administrator
 2    of the division of building safety:
 3        Electrical contractor's license                                    $125.00
 4        Renewal of electrical contractor's license                          100.00
 5        Journeyman electrician's license                                     25.00
 6        Renewal of journeyman electrician's license                          15.00

Statement of Purpose / Fiscal Impact


                      STATEMENT  OF  PURPOSE
                             RS08344
Decrease the renewal fee for the Master Journeyman Electrician
license in Idaho Code, title 54, chapter 10, from $25.00 to $15.00
per year to be consistent with the Journeyman Electrician and
Specialty Journeyman Electrician renewal fee.  The procedure to
renew these licenses are the same, the Master Journeyman renewal
does not require any additional processing, so the larger fee is
not justified.

Change the electrical license category name of "Master Journeyman
Electrician," in Idaho Code, title 54, chapter 10, to "Master
Electrician."  The progression of electrical knowledge and
experience is from apprentice electrician to journeyman electrician
to master electrician.  The term "master journeyman" is confusing
and contradictory.  This is especially true with other states and
jurisdictions that have, or wish to enter into reciprocal
agreements with Idaho.
