H0270|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 270 BY COMMERCE AND HUMAN RESOURCES COMMITTEE 1 AN ACT 2 RELATING TO LEAVE TIME UNDER THE STATE PERSONNEL SYSTEM; AMENDING SECTION 3 67-5335, IDAHO CODE, TO PROVIDE THAT, WITH THE APPROVAL OF THE APPOINTING 4 AUTHORITY FOR BOTH THE TRANSFERRING AND RECEIVING OFFICER OR EMPLOYEE, AN 5 OFFICER OR EMPLOYEE MAY TRANSFER ACCRUED VACATION LEAVE, UP TO A MAXIMUM 6 OF FORTY HOURS PER FISCAL YEAR, TO, OR FOR THE USE OF, ANOTHER OFFICER OR 7 EMPLOYEE FOR PURPOSES OF SICK LEAVE IN THE EVENT THE RECEIVING OFFICER OR 8 EMPLOYEE OR A FAMILY MEMBER SUFFERS FROM A SERIOUS ILLNESS OR INJURY. 9 Be It Enacted by the Legislature of the State of Idaho: 10 SECTION 1. That Section 67-5335, Idaho Code, be, and the same is hereby 11 amended to read as follows: 12 67-5335. VACATION TIME -- ELIGIBILITY -- MAXIMUM TIME -- RIGHT TO ANNUAL 13 VACATION. (1) An appointing authority shall permit each officer or employee to 14 take vacation leave to the extent such leave has accrued. 15 (2) Vacation leave may be accrued and accumulated only as follows, unless 16 amounts in excess of the permitted accumulations have been expressly autho- 17 rized in writing by the board of examiners during unusual or emergency situa- 18 tions: 19 During the first ten thousand four hundred (10,400) hours of credited 20 state service, vacation leave may be accrued and accumulated to a maximum of 21 one hundred ninety-two (192) hours; 22 During the second ten thousand four hundred (10,400) hours of credited 23 state service, vacation leave may be accrued and accumulated to a maximum of 24 two hundred forty (240) hours; 25 During the third ten thousand four hundred (10,400) hours of credited 26 state service, vacation leave may be accrued and accumulated to a maximum of 27 two hundred eighty-eight (288) hours; 28 After thirty-one thousand two hundred (31,200) hours of credited state 29 service, vacation leave may be accrued and accumulated to a maximum of three 30 hundred thirty-six (336) hours. 31 (3) Vacation leave shall be transferable from department to department 32 only to the extent that it is accrued and accumulated. 33 (4) Vacation leave shall not be earned, accrued or accumulated during any 34 pay period in which the maximum accruals and accumulations provided by this 35 section have been met. 36 (5) Vacation leave not taken shall be compensated for at the time of sep- 37 aration only to the maximum accruals and accumulations allowed by this sec- 38 tion. 39 (6) Vacation leave shall be taken on a workday basis. Regularly scheduled 40 days off and officially designated holidays falling within a period of vaca- 41 tion leave shall not be counted against vacation leave. Vacation leave shall 42 not be taken in advance of being earned and shall only be taken in pay periods 43 subsequent to being earned. 2 1 (7) With the approval of the appointing authority for both the transfer- 2 ring and receiving officer or employee, an officer or employee may transfer 3 accrued vacation leave, up to a maximum of forty (40) hours per fiscal year, 4 to , or for the use of, another officer or employee for purposes 5 of sick leave in the event the receiving officer or employee or a family mem- 6 ber suffers from a serious illness or injury. The amount transferred shall be 7 converted to sick leave. An officer or employee shall not be allowed to 8 receive more than one hundred sixty (160) hours of transferred leave per fis- 9 cal year, and a transfer shall not occur until the receiving employee has 10 exhausted all of his or her accrued sick and vacation leave. An officer or 11 employee shall not be eligible to transfer vacation leave unless his or her 12 balance exceeds eighty (80) hours, and in no event may an officer or employee 13 transfer an amount of accrued leave which would result in an accrued balance 14 of less than eighty (80) hours.
STATEMENT OF PURPOSE RS 08865 The purpose of this legislation is to allow State agencies to create a "bank" or "pool" thus permitting employees to donate vacation leave to this pool. This would provide higher education with the ability to allow faculty who do not earn vacation leave to apply for shared leave in the event of serious illness and to provide anonymity for those employees wishing to keep private their illness.
