HCR022|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 22 BY STATE AFFAIRS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF THE IDAHO 3 PUBLIC UTILITIES COMMISSION RELATING TO INTERCONNECTION AND ACCESS STAN- 4 DARDS FOR FACILITIES-BASED TELEPHONE CORPORATIONS THAT PROVIDE BASIC LOCAL 5 SERVICE IN NEW TELECOMMUNICATIONS DEVELOPMENT AREAS. 6 Be It Resolved by the Legislature of the State of Idaho: 7 WHEREAS, the Legislature is vested with authority to reject executive 8 agency rules under the provisions of Section 67-5291, Idaho Code, in the event 9 that the Legislature finds that the rules are not consistent with legislative 10 intent; and 11 WHEREAS, it is the finding of the Legislature that certain rules of the 12 Idaho Public Utilities Commission relating to interconnection and access stan- 13 dards for facilities-based telephone corporations that provide basic local 14 service in new telecommunications development areas are not consistent with 15 legislative intent and should be rejected. 16 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 17 of the Fifty-fifth Idaho Legislature, the House of Representatives and the 18 Senate concurring therein, that IDAPA 31.42.01, Sections 401 through and 19 including Section 411, rules of the Idaho Public Utilities Commission relating 20 to interconnection and access standards for facilities-based telephone corpo- 21 rations that provide basic local service in new telecommunications development 22 areas, adopted as a pending rule under Docket Number 31-4201-9801, be, and the 23 same are hereby rejected and declared null, void and of no force and effect.
