S1113|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1113 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO IMPLEMENTS OF HUSBANDRY AND FARM TRACTORS; AMENDING SECTION 3 49-619, IDAHO CODE, TO DELETE REFERENCE TO LIGHTING REQUIREMENTS FOR 4 IMPLEMENTS OF HUSBANDRY AND FARM TRACTORS OPERATED DURING HOURS OF DARK- 5 NESS AND TO DELETE EMBLEM REQUIREMENTS FOR SUCH VEHICLES; AMENDING SECTION 6 49-916, IDAHO CODE, TO CLARIFY THAT IMPLEMENTS OF HUSBANDRY AND FARM TRAC- 7 TORS OPERATED DURING HOURS OF DARKNESS ARE SUBJECT TO THE LIGHTING 8 REQUIREMENTS OF THIS LAW UP TO A SPECIFIED MAXIMUM WIDTH AND TO PROVIDE 9 THAT SUCH VEHICLES OPERATING IN EXCESS OF SPECIFIED MAXIMUM WIDTHS ARE 10 SUBJECT TO ADDITIONAL LIGHTING AND PILOT VEHICLE REQUIREMENTS AS PROVIDED 11 IN SECTION 49-1012, IDAHO CODE, AND TO MAKE TECHNICAL CORRECTIONS; AND 12 AMENDING SECTION 49-1012, IDAHO CODE, TO PROVIDE ADDITIONAL LIGHTING AND 13 PILOT VEHICLE REQUIREMENTS FOR IMPLEMENTS OF HUSBANDRY AND FARM TRACTORS 14 OPERATED DURING HOURS OF DARKNESS WHEN EXCEEDING SPECIFIED WIDTHS. 15 Be It Enacted by the Legislature of the State of Idaho: 16 SECTION 1. That Section 49-619, Idaho Code, be, and the same is hereby 17 amended to read as follows: 18 49-619. SLOW MOVING VEHICLES -- RESTRICTION, EQUIPMENT -- EMBLEMS ON CER- 19 TAIN MACHINERY. (1) Except for emergency and snow removal vehicles owned and 20 operated by the state or its political subdivisions when enroute to, from, or 21 in the performance of activities essential to the public safety,and22implements of husbandry, except on interstate highways, equipped with lights23as required by section 49-916, Idaho Code, when being moved from one (1) farm24operation to another, and implements of husbandry when operating from one-half25hour after sunset to one-half hour before sunrise shall have flashing lamps26visible from a distance of not less than five hundred (500) feet to the rear,27it shall be unlawful to operate a slow moving vehicle on the highways 28 at the following times and under the following circumstances: 29 (a) From a half hour after sunset to a half hour before sunrise; 30 (b) At a speed in excess of twenty-five (25) miles per hour; 31 (c) In such a manner as to obstruct the free movement of traffic on the 32 highways. 33 (2) A slow moving vehicle shall be equipped with a foot brake and with a 34 mechanical signaling device as required for other similarly constructed vehi- 35 cles. 36 (3) All slow moving vehicles, farm tractors, road rollers and37implements of husbandryshall have affixed at the rear of the vehicle 38 an emblem identifying them as slow moving equipment. The Idaho traffic safety 39 commission shall recommend to the board the minimum standards for the emblem. 40 SECTION 2. That Section 49-916, Idaho Code, be, and the same is hereby 41 amended to read as follows: 2 1 49-916. LAMPS ON FARM TRACTORS, FARM EQUIPMENT AND IMPLEMENTS OF HUS- 2 BANDRY. (1) Every farm tractor and every self-propelled farm equipment unit or 3 implement of husbandry not equipped with an electric lighting system shall at 4 all times specified in section 49-903, Idaho Code, be equipped with at least 5 one (1) lamp displaying a white light visible from a distance of not less than 6 five hundred (500) feet to the front of the vehicle and shall also be equipped 7 with at least one (1) lamp displaying a red light visible from at least the 8 same distance to the rear of the vehicle, and two (2) red reflectors visible 9 from a distance of one hundred (100) to six hundred (600) feet to the rear 10 when illuminated by the upper beams of head lamps. Lights required in this 11 section shall be positioned so that one (1) lamp showing to the front and one 12 (1) lamp or reflector showing to the rear will indicate the further projection 13 of the tractor, unit or implement on the side of the road used in passing the 14 vehicle. 15 (2) Every combination of farm tractor and towed unit of farm equipment or 16 implement of husbandry not equipped with an electric lighting system shall at 17 all times specified in section 49-903, Idaho Code, be equipped with the fol- 18 lowing: 19 (a) At least one (1) lamp mounted to indicate as nearly as practicable 20 the extreme left projection of the combination and displaying a white 21 light visible from a distance of not less than five hundred (500) feet to 22 the front of the combination; 23 (b) Two (2) red reflectors visible from a distance of one hundred (100) 24 to six hundred (600) feet to the rear of the combination when illuminated 25 by the upper beams of head lamps. The reflectors shall be mounted in a 26 manner to indicate as nearly as practicable the extreme left and right 27 rear projections of the towed unit or implement on the highway. 28 (3) Every farm tractor and every self-propelled unit of farm equipment or 29 implement of husbandry equipped with an electric lighting system shall at all 30 times specified in section 49-903, Idaho Code, be equipped with two (2) sin- 31 gle-beam or multiple-beam head lamps meeting the requirements of section32s49-922 or 49-924, Idaho Code, respectively or, as an alternative, 33 section 49-926, Idaho Code, and two (2) red lamps visible from a distance of 34 not less than five hundred (500) feet to the rear, or in the alternative, one 35 (1) red lamp visible from a distance of not less than five hundred (500) feet 36 to the rear and two (2) red reflectors visible from a distance of one hundred 37 (100) to six hundred (600) feet to the rear when illuminated by the upper 38 beams of head lamps. Red lamps or reflectors shall be mounted in the rear of 39 the farm tractor or self-propelled implement of husbandry to indicate as 40 nearly as practicable the extreme left and right projections of the vehicle on 41 the highway. 42 (4) The farm tractor element of every combination of farm tractor and 43 towed farm equipment or towed implement of husbandry equipped with an electric 44 lighting system shall at all times specified in section 49-903, Idaho Code, be 45 equipped with two (2) single-beam or multiple-beam head lamps meeting the 46 requirements of sections49-922, 49-924,or 49-926, 47 Idaho Code. 48 (5) Implements of husbandry not exceeding eight (8) feet six (6) 49 inches in width and farm tractors not exceeding nine (9) feet in width shall 50 be subject to lighting requirements as specified in this section. 51 (6) In addition to the lighting requirements specified in this section, 52 implements of husbandry exceeding eight (8) feet six (6) inches in width and 53 farm tractors exceeding nine (9) feet in width shall also be subject to addi- 54 tional lighting and pilot vehicle requirements as provided in section 49-1012, 55 Idaho Code. 3 1 SECTION 3. That Section 49-1012, Idaho Code, be, and the same is hereby 2 amended to read as follows: 3 49-1012.TEMPORARYMOVEMENT OFHARVESTING MACHINERY4AFTERIMPLEMENTS OF HUSBANDRY AND FARM TRACTORS DURING HOURS OF 5 DARKNESS.Notwithstanding any other provision of law, harvesting6machineryImplements of husbandry exceeding eight (8) feet six 7 (6) inches in width and farm tractors exceeding nine (9) feet in width 8 may be moved during hours of darkness when that machinery is equipped, in 9 addition to those requirements set forth in chapter 9, title 49, Idaho Code, 10 with a flashing amber-colored light at least four (4) inches in diameter 11 clearly visible from in front of the machinery, a flashing red-colored light 12 at least four (4) inches in diameter clearly visible from the back of the 13 machinery, and the machinery is preceded by a well-lighted pilot vehicle or 14 flagman at least three hundred (300) feet in advance of the vehicle to give 15 warning of the approach of the equipment and followed by a well-lighted pilot 16 vehicle or flagman at least three hundred (300) feet behind the vehicle to 17 give warning of the presence of the equipment on the highway.

The purpose of this legislation would be to clarify when
implements of husbandry are allowed to travel at night, and at
what width. It would also clarify which of the following code
section(s) 49-619 and/or 49-916 and/or 49-1012, govern the
movement of implements of husbandry and/or more specifically,
harvesting machinery. These code sections are very hard to
enforce, because of the vagueness and ambiguities among them.
Legislative clarification will result in safer movement of
these vehicles.
