S1156|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1156 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO CONTRIBUTIONS BY NONREPORTING COMMITTEES REGARDING INITIATIVE OR 3 REFERENDUM MEASURES; AMENDING CHAPTER 66, TITLE 67, IDAHO CODE, BY THE 4 ADDITION OF A NEW SECTION 67-6605A, IDAHO CODE, TO REQUIRE REPORTING 5 REQUIREMENTS FOR CONTRIBUTIONS OVER TWO HUNDRED DOLLARS FROM NONREPORTING 6 COMMITTEES BY A POLITICAL TREASURER OF A COMMITTEE IN SUPPORT OR IN OPPO- 7 SITION TO AN INITIATIVE OR REFERENDUM MEASURE, TO PROVIDE FOR RETURN OF 8 CONTRIBUTIONS FROM NONREPORTING COMMITTEES NOT IN COMPLIANCE WITH REQUIRE- 9 MENTS AND TO REQUIRE REPORTS. 10 Be It Enacted by the Legislature of the State of Idaho: 11 SECTION 1. That Chapter 66, Title 67, Idaho Code, be, and the same is 12 hereby amended by the addition thereto of a NEW SECTION , to be 13 known and designated as Section 67-6605A, Idaho Code, and to read as follows: 14 67-6605A. CONTRIBUTIONS TO NONREPORTING COMMITTEES REGARDING INITIATIVE 15 AND REFERENDUM MEASURES. (1) A political treasurer of a committee in support 16 or opposition to an initiative or referendum measure on the general election 17 ballot shall not accept a contribution of more than two hundred dollars ($200) 18 from a political committee not domiciled in the state of Idaho and not other- 19 wise required to report under this chapter (a "nonreporting committee"), 20 unless the contribution is accompanied by a written statement setting forth 21 the full name and complete address of each person who contributed more than 22 two hundred dollars ($200) to the nonreporting committee during the preceding 23 twelve (12) month period and certified as true and correct by an officer of 24 the nonreporting committee. The political treasurer shall file with the sec- 25 retary of state a copy of the written statement required in this subsection 26 within thirty (30) calendar days after receipt of the report from the 27 nonreporting committee. The political treasurer shall attest on a form sup- 28 plied by the secretary of state as to the correctness of the copy submitted to 29 the secretary of state. 30 (2) All contributions of more than two hundred dollars ($200) from a 31 nonreporting committee to a committee in support or opposition to an initia- 32 tive or referendum measure on the general election ballot, unaccompanied by a 33 written statement setting forth the full name and complete address of each 34 person who contributed more than two hundred dollars ($200) to the 35 nonreporting committee shall be returned to the nonreporting committee. The 36 political treasurer shall file with the secretary of state a report of the 37 number and amount of contributions returned to the nonreporting committee pur- 38 suant to this subsection within thirty (30) days after the contributions have 39 been returned to the nonreporting committee.
STATEMENT OE PURPOSE RS08969 Under Idaho Law our citizens are frequently not able to determine the source of out of state funding in support of or against ballot initiatives. This proposal would change our "Sunshine Law" to require out of state committees sending money into Idaho in support of or against initiative and referendum measures to report the names and addresses of contributors to the Idaho Secretary of State.
