SCR126|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE CONCURRENT RESOLUTION NO. 126 BY STATE AFFAIRS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO 3 APPOINT A COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY OF PARI-MUTUEL 4 WAGERING ON SIMULCAST RACING. 5 Be It Resolved by the Legislature of the State of Idaho: 6 WHEREAS, the state of Idaho adopted a system of pari-mutuel wagering on 7 simulcast or televised races in 1990 for the expressed purpose of allowing 8 Idaho's live race industry, "in conjunction with the Idaho Racing Commission, 9 to put in place a responsible simulcasting program that will be used to bene- 10 fit and strengthen the entire Idaho equine industry, and thus strengthen 11 Idaho's agricultural based economy"; and 12 WHEREAS, since the inception of pari-mutuel wagering on simulcast racing 13 in Idaho, the number of live horse races has steadily declined even though 14 both simulcast wagering and the cost of regulation have grown significantly; 15 and 16 WHEREAS, the statutory scheme governing Idaho's live race industry and 17 simulcast wagering is confusing and inconsistent, difficult to fairly and con- 18 sistently administer, resulting in the exclusion of some tracks from partici- 19 pation in the simulcast industry, and further resulting in the failure of the 20 industry to successfully capture revenue from wagering on simulcast racing for 21 enhancement of live racing leading to the possible loss of the live race 22 industry in Idaho. 23 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 24 of the Fifty-fifth Idaho Legislature, the Senate and the House of Representa- 25 tives concurring therein, that the Legislative Council is authorized to 26 appoint a committee to undertake and complete a study of live racing and 27 pari-mutuel wagering on simulcast or televised racing in the state of Idaho. 28 The study shall address whether and how revenues from wagering on simulcast 29 racing can be employed to enhance live horse racing in the state of Idaho; 30 whether the current regulatory mechanism should be continued or altered to 31 serve the best interest of racing in Idaho; and, whether better or alternative 32 means of public or private action exist to enhance live horse racing in Idaho. 33 The Legislative Council shall determine the number of legislators and member- 34 ship from each house appointed to the committee and shall authorize the com- 35 mittee to receive input, advice and assistance from interested and affected 36 parties who are not members of the Legislature. 37 BE IT FURTHER RESOLVED that the Idaho Racing Commission and the Idaho Lot- 38 tery Commission will each have one nonvoting representative on the Committee. 39 BE IT FURTHER RESOLVED that the committee shall report its findings, rec- 40 ommendations and proposed legislation, if any, to the Second Regular Session 41 of the Fifty-fifth Idaho Legislature.
