  1                                        AN ACT
  2    RELATING TO THE IDAHO BOARD OF PODIATRY; AMENDING SECTION 54-608, IDAHO  CODE,
  3        TO  PROVIDE  FOR REVOCATION, SUSPENSION OR DENIAL OF A LICENSE FOR REASONS
  4        OF MENTAL ILLNESS, PHYSICAL ILLNESS OR HAVING A  COMMUNICABLE,  CONTAGIOUS
  5        OR  INFECTIOUS DISEASE AND TO MAKE TECHNICAL CORRECTIONS; AND PROVIDING AN
  6        EFFECTIVE DATE.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  That Section 54-608, Idaho Code, be, and the  same  is  hereby
  9    amended to read as follows:
                                                                        
 10        54-608.  GROUNDS FOR SUSPENSION, DENIAL, REFUSAL TO RENEW OR REVOCATION OF
 11    LICENSE. No license may be issued, and a license previously issued may be sus-
 12    pended or revoked, if the person applying, or the person licensed is:
 13        (1.)  Found guilty by a court of competent jurisdiction of a felony or any
 14    offense involving moral turpitude;
 15        (2.)  Found  by  the  board  to  be a repeated and excessive abuser of any
 16    drug, including alcohol, or any controlled substance;
 17        (3.)  Found by the board to be in violation of any provision of  this  act
 18    or the rules promulgated pursuant thereto;
 19        (4.)  Found  by the board to have used fraud or deception in the procuring
 20    of any license;
 21        (5.)  Found by the board to have had any action,  including  denial  of  a
 22    license  or  the  voluntary surrender of or voluntary limitation on a license,
 23    taken against the licensee by any peer review body, any health  care  institu-
 24    tion,  any  professional  medical  society  or  association  or any court, law
 25    enforcement or governmental agency; or
 26        (6.)  Found by the board to have been unethical, unprofessional or dishon-
 27    orable in the practice of healing the sick; or
 28        (7)  Found by the board to be unable to practice podiatry with  reasonable
 29    skill and safety by reason of:
 30        (a)  Mental illness; or
 31        (b)  Physical  illness  including, but not limited to, physical deteriora-
 32        tion which adversely affects cognitive, motor or perceptive skills; or
 33        (c)  Having a communicable, contagious or infectious disease which  endan-
 34        gers the health of patients.
                                                                        
 35        SECTION  2.  This  act shall be in full force and effect on and after July
 36    1, 2000.

revocation or suspension of a license or grounds for denial for
reasons of mental illness, physical illness or having a
communicable, contagious or infectious disease.






                         FISCAL IMPACT
                                
There is no fiscal impact to the general fund or dedicated funds.
