H0475|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 475 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE SECRETARY OF STATE; REPEALING SECTION 67-916, IDAHO CODE; 3 TRANSFERRING MONEYS IN THE COMMERCIAL AFFAIRS ADMINISTRATIVE FUND TO THE 4 GENERAL FUND; AND PROVIDING AN EFFECTIVE DATE. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 67-916, Idaho Code, be, and the same is hereby 7 repealed. 8 SECTION 2. All moneys in the Commercial Affairs Administrative Fund (fund 9 number 0235) shall be transferred to the General Fund on July 1, 2000. 10 SECTION 3. This act shall be in full force and effect on and after July 11 1, 2000.
STATEMENT OF PURPOSE RS09702 The purpose of this legislation is to eliminate the Secretary of State's "commercial affairs" dedicated account, and thereby require all Secretary of State revenues to be deposited into the general fund. The "commercial affairs" account was established in 1992 to establish a revenue source outside the general fund to fund capital expenditures. After considering the continued necessity and viability of this dedicated account, the Secretary of State office has concluded that the extra programming costs and record keeping involved in tracking two accounts (general and dedicated) is not necessary. In regard to capital expenditures needs, the legislature has responded when a need has been demonstrated. FISCAL NOTE This legislation should result in a $700,000 gain to the general fund in F.Y. 2001, as well as $500,000 positive cash flow to the general fund on an annual basis.
