H0662|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 662 BY JUDICIARY, RULES AND ADMINISTRATION COMMITTEE 1 AN ACT 2 RELATING TO PENAL PROVISIONS OF LIQUOR LAW; AMENDING CHAPTER 6, TITLE 23, 3 IDAHO CODE, BY THE ADDITION OF A NEW SECTION 23-616, IDAHO CODE, TO PRO- 4 VIDE A MISDEMEANOR PENALTY FOR PERSONS UNDER TWENTY-ONE YEARS OF AGE TO BE 5 PRESENT OR ON THE PREMISES OF ANY PLACE WHERE BEER, WINE OR OTHER ALCO- 6 HOLIC BEVERAGES ARE BEING UNLAWFULLY CONSUMED, POSSESSED OR DISTRIBUTED; 7 AND PROVIDING AN EFFECTIVE DATE. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Chapter 6, Title 23, Idaho Code, be, and the same is 10 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 11 ignated as Section 23-616, Idaho Code, and to read as follows: 12 23-616. UNLAWFUL FOR PERSONS UNDER TWENTY-ONE YEARS OF AGE TO BE PRESENT. 13 It shall be unlawful for any person under twenty-one (21) years of age to be 14 present at or on the premises of any place where he knows any beer, wine or 15 any other alcoholic beverages are being consumed, possessed or distributed 16 unlawfully by persons under the age of twenty-one (21) years. Violation of the 17 provisions of this section shall constitute a misdemeanor and shall be pun- 18 ished according to the schedule set out in section 18-1502, Idaho Code. 19 SECTION 2. This act shall be in full force and effect on and after July 20 1, 2000.
STATEMENT OF PURPOSE RS 09645 This bill would provide law enforcement with a specific statute dealing with juvenile offenders who are frequenting places where alcohol is unlawfully possessed, consumed or distributed to minors. This statute would be similar in nature to Idaho Code 37-2732(d) regarding frequenting a place where drugs are used, held, manufactured or distributed. FISCAL IMPACT None. Contact Name: Rep.
