2026 Proposed Constitutional Amendments
During the 2025 legislative session, the Idaho Legislature adopted two resolutions that propose amendments to the Constitution of the State of Idaho. Both will appear on the November 2026 ballot for approval by the citizens of Idaho.
Section 67-453, Idaho Code requires the Legislative Council to prepare a “brief statement setting forth in simple, understandable language the meaning and purpose of the proposed amendment” as well as a “concise presentation of the major arguments advanced by the proponents and opponents.” Only the brief statement of meaning will appear on the November ballot, while both the brief statement as well as the arguments for and against will be included in the publications that the Secretary of State is required to publish prior to the election. The Legislative Council is required to submit these statements and arguments to the Secretary of State 120 days prior to the election. This deadline falls on July 6, 2026.
On behalf of the Legislative Council, the Legislative Services Office is inviting your suggestions on arguments for or against the proposed constitutional amendments, which will have the following questions submitted to voters on the November ballot:
HJR 4 proposes an amendment to Section 26, Article III, as follows:
Shall Section 26, Article III of the Constitution of the State of Idaho be amended to provide that only the legislature shall the power and authority to legalize the growing, producing, manufacturing, transporting, selling, delivering, dispensing, administering, prescribing, distributing, possessing, or using of marijuana, narcotics, or other psychoactive substances?
HJR 6 proposes adding a new section to Article X, as follows:
Shall Article X of the Constitution of the State of Idaho be amended to make English the official state language?
By law, if any of these suggestions are utilized by the Legislative Council, no recognition can be given to the person(s) or group(s) that submitted the argument.
