SPEAKER Requested by: Department of Fish and Game 1 AN ACT 2 RELATING TO FISH AND GAME; AMENDING CHAPTER 15, TITLE 36, IDAHO CODE, BY THE 3 ADDITION OF A NEW SECTION 36-1512, IDAHO CODE, TO PROVIDE FOR REGULATION 4 OF WINTER FEEDING OF BIG GAME, TO PROVIDE LEGISLATIVE INTENT, TO REQUIRE 5 PERMITS FOR WINTER FEEDING, TO SET THE PERMIT APPLICATION FEE AND TO 6 AUTHORIZE RULEMAKING. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Chapter 15, Title 36, Idaho Code, be, and the same is 9 hereby amended by the addition thereto of a NEW SECTION , to be 10 known and designated as Section 36-1512, Idaho Code, and to read as follows: 11 36-1512. REGULATION OF BIG GAME WINTER FEEDING -- INTENT -- PERMITS -- 12 PROHIBITION -- RULEMAKING. (1) The legislature finds that big game is an 13 invaluable asset of the state of Idaho and should be maintained under natural 14 conditions with naturally available forage. Winter feeding of big game by 15 humans should be undertaken only to protect public health, safety and welfare, 16 to prevent transmission of disease to livestock and wildlife, to prevent dam- 17 age to private property, to minimize depredation, and to prevent excess mor- 18 tality of big game in areas where the mortality would jeopardize the recovery 19 of the herd. The legislature has made the department responsible for big game 20 winter feeding under the provisions of section 36-111(1)(d), Idaho Code, with 21 the advice of the winter feeding advisory committees provided in section 22 36-123, Idaho Code. Therefore, it is the intent of the legislature that all 23 winter feeding of big game should be regulated by the department of fish and 24 game. 25 (2) No person other than the department shall intentionally feed big game 26 in this state unless the person has been issued a permit by the director or 27 his designee. The permit application fee shall be fifty dollars ($50.00), 28 which shall be deposited in the winter feeding account established in section 29 36-111(1)(c), Idaho Code. 30 (3) The commission is authorized and directed to promulgate rules to 31 establish the criteria for issuance of winter feeding permits and the require- 32 ments of the permits. The criteria and requirements shall include, but are not 33 limited to, the financial responsibility of the person to maintain winter 34 feeding, the location of the proposed feeding and its proximity to livestock, 35 public roads and private property, the management plan for the big game to be 36 fed, and the necessity for winter feeding.
STATEMENT OF PURPOSE RS0731 1 This legislation will regulate the winter feeding of big game animals other than by the Department of Fish and Game. Winter feeding concentrates animals raising public safety and animal health concerns. Winter feeding activity needs to be regulated to: (1 ) protect public health, safety, and welfare; (2) minimize the potential for transmission of disease to livestock and wildlife; (3) maintain normal movement of big game animals to winter ranges. A permit would be required for any person other than the Department to intentionally feed big game. The legislation provides for a fifty ($50) dollar application fee to be deposited in the winter feeding account. The Fish and Game Commission is authorized and directed to promulgate rules to establish the criteria for issuance and requirements of winter feeding permits. FISCAL IMPACT The application fee will provide some funds to the winter feeding account established by Section 36-1 11(1)(c), Idaho Code. The exact amount is unknown, but it is estimated there will be approximately private winter feeding sites during the winter of 1996-97.
