H0544|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 544 BY CLARK 1 AN ACT 2 RELATING TO CONTRACTS OF POLITICAL SUBDIVISIONS AND UTILITIES; AMENDING CHAP- 3 TER 23, TITLE 67, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 67-2332A, 4 IDAHO CODE, TO PROVIDE THAT A POLITICAL SUBDIVISION MAY CONTRACT WITH ANY 5 OTHER POLITICAL SUBDIVISION OR A REGULATED PUBLIC UTILITY TO COOPERATE IN 6 THE PROVISION OF PUBLIC OR PRIVATE UTILITY SERVICES ON A COLLABORATIVE 7 BASIS, PROVIDING TYPES OF COLLABORATION, AND PROVIDING METHODS AND PRAC- 8 TICES. 9 Be It Enacted by the Legislature of the State of Idaho: 10 SECTION 1. That Chapter 23, Title 67, Idaho Code, be, and the same is 11 hereby amended by the addition thereto of a NEW SECTION , to be 12 known and designated as Section 67-2332A, Idaho Code, and to read as follows: 13 67-2332A. POLITICAL SUBDIVISION CONTRACTS -- UTILITIES. Notwithstanding 14 any other provision of law, any political subdivision of the state of Idaho 15 may contract, by written agreement, with any other political subdivision of 16 the state of Idaho or with any regulated public utility in the state of Idaho 17 to cooperate in the provision of public or private utility services on a col- 18 laborative basis. Such collaboration may include joint service provision, 19 joint billing and/or collection, cooperation in the initiation or termination 20 of service, and such other measures as might be developed to facilitate the 21 cost-effective provision of public utility service to residential and business 22 customers. Such cooperation shall allow use of methods and practices in any 23 such joint undertaking which could be employed by any single participant 24 therein acting alone.
STATEMENT OF PURPOSE RS 07689 This legislation would allow a political subdivision to contract with another public subdivision or a regulated public utility to cooperate in the provision of public or private utility services on a collaborative basis.
