 1                                        AN ACT
 2    RELATING TO WORKER'S COMPENSATION; REPEALING SECTION 72-442, IDAHO CODE,  PER-
 3        TAINING TO WILFUL SELF-EXPOSURE.

 4    Be It Enacted by the Legislature of the State of Idaho:

 5        SECTION  1.  That  Section  72-442, Idaho Code, be, and the same is hereby
 6    repealed.

Statement of Purpose / Fiscal Impact


    





                          STATEMENT OF PURPOSE
    
                                 RS 07724
    
    Idaho Code, §72-442, provides that under certain circumstances and 
    in certain cases an employee shall not receive compensation if 
    injury is due to employee's fault. The Idaho Workers' Compensation 
    Act is a "no fault" system and the repeal of §72442, is consistent 
    with this intent. Truly wilful self-exposure, as opposed to 
    negligence, is addressed in §72-208 (1), Wilful Intention.
