                         BY RESOURCES AND CONSERVATION COMMITTEE

 1                                        AN ACT
 2    RELATING TO THE IDAHO SAFE BOATING ACT; AMENDING SECTION 67-7077, IDAHO  CODE,
 3        TO  ALLOW  A  WATER  VESSEL TO SAFELY OPERATE WITHIN ONE HUNDRED FEET OF A
 4        DOCK WHEN DROPPING OFF A WATER SKIER WHO IS TWELVE YEARS OF AGE  OR  YOUN-
 5        GER.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION  1.  That  Section 67-7077, Idaho Code, be, and the same is hereby
 8    amended to read as follows:

 9        67-7077.  OPERATION OF VESSELS. It shall be unlawful  for  any  person  to
10    operate  any  vessel  on the water of this state: (a) in a negligent manner as
11    prescribed in section 67-7017, Idaho Code, while within one hundred (100) feet
12    of another vessel; or (b) at a speed greater than no wake or  five  (5)  miles
13    per  hour while within one hundred (100) feet of a dock, swimmer or other per-
14    son in the water, except when safely pulling a water skier from a dock  ,
15    or  when  safely dropping off a water skier who is twelve (12) years of age or
16    younger at or near a dock,  or when the swimmer or other person  in  the
17    water is the vessel's water skier.

    This proposal allows some flexibility for water skiers 
    under 12 years of age to be dropped off closer to the shore or 
    dock.
