                            HOUSE CONCURRENT RESOLUTION NO. 51

 1                               A CONCURRENT RESOLUTION
 2    STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO
 3        APPOINT A COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY TO  INVESTIGATE  THE
 4        HISTORICAL,  FUNDING  AND  BIOLOGICAL REASONS FOR THE DECREASE IN THE BULL
 5        TROUT POPULATION AND WHAT CAN BE DONE TO  RESTORE  THAT  POPULATION  IN  A
 6        COST-EFFECTIVE MANNER.

 7    Be It Resolved by the Legislature of the State of Idaho:

 8        WHEREAS,  Idaho's  rivers  and streams once provided a rich and nourishing
 9    habitat for Bull Trout; and
10        WHEREAS, the Bull Trout population thrived when their natural habitat  was
11    left undisturbed; and
12        WHEREAS,  decreases  in  water  quality  and other habitat attributes have
13    adversely affected the Bull Trout;
14        WHEREAS, the Bull Trout population in Idaho has diminished so far that the
15    fish is close to being listed as an endangered species by the federal  govern-
16    ment; and
17        WHEREAS, such a listing would negatively affect recreation and commerce in
18    Idaho; and
19        WHEREAS,  the  issue  of the health of the Bull Trout is so important that
20    the Governor of the state of Idaho has developed a Bull Trout Management  Plan
21    in  an  attempt  to restore Bull Trout populations and remove the need to list
22    the fish as an endangered species.
23        NOW, THEREFORE, BE IT RESOLVED by the members of the Second  Regular  Ses-
24    sion  of  the Fifty-fourth Idaho Legislature, the House of Representatives and
25    the Senate concurring therein, that the Legislative Council is  authorized  to
26    appoint a committee to investigate the historical, funding and biological rea-
27    sons  for  the  decrease in the Bull Trout population in Idaho and what can be
28    done to restore that population in a cost-effective  manner.  The  Legislative
29    Council  shall  determine  the  number of legislators and membership from each
30    house appointed to the committee and shall authorize the committee to  receive
31    input,  advice and assistance from interested and affected parties who are not
32    members of the legislature.
33        BE IT FURTHER RESOLVED that nonlegislative members of the committee  shall
34    not  be  reimbursed  from  legislative  funds  for  per diem, mileage or other
35    expenses and shall not have voting privileges regarding the committee's recom-
36    mendations or proposed legislation.
37        BE IT FURTHER RESOLVED that the committee shall report its findings,  rec-
38    ommendations and proposed legislation, if any, to the First Regular Session of
39    the Fifty-fifth Idaho Legislature.

                          STATEMENT OF PURPOSE

    The purpose of this legislation is to create a committee to 
    review and investigate whether bull trout in the State of Idaho 
    warrants a listing either threatened or endangered and if so was 
    its habitat and health instigated by state or federal agencies in 
    a manner by predetermined design to gain endangered species status 
    for agency gain.
