S1324|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1324 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO THE IDAHO BOARD OF OPTOMETRY; AMENDING SECTION 54-1522, IDAHO 3 CODE, TO ESTABLISH A PENALTY FEE OF ONE HUNDRED FIFTY DOLLARS FOR REIN- 4 STATEMENT OF A LICENSE. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 54-1522, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 54-1522. LICENSES -- ISSUANCE -- RENEWAL -- RECORDING AND DISPLAY. If the 9 applicant shall pass a satisfactory examination and shall show that he is a 10 person of good moral character and that he possesses the qualifications 11 required in this chapter to entitle him to be licensed as an optometrist, 12 then, upon request, such applicant shall be entitled to a license authorizing 13 the applicant to practice optometry in the state of Idaho. All licenses to 14 practice optometry shall be issued in the name of the Idaho state board of 15 optometry with the seal thereof attached. All licenses so issued shall expire 16 on the thirtieth day of June following the issuance of the license and all 17 persons who practice optometry within the meaning of this chapter are entitled 18 to renew and shall renew their licenses on the first day of July each calendar 19 year. The failure to timely renew a license under this section shall 20 require the payment of a fee of one hundred fifty dollars ($150) for a license 21 renewal in addition to other fees which may be required, or other sanctions 22 which may be imposed under this act. Every person to whom a license is 23 granted shall display the same, or a copy of the same certified to by the 24 board in a conspicuous part of his office wherein the practice of optometry is 25 conducted. It shall be unlawful for any person to practice optometry in the 26 state of Idaho before complying with these requirements. 27 Any person licensed to practice optometry in the state of Idaho on the 28 effective date of this act shall be eligible to renew his license on the first 29 day of July following the effective date of this act.
STATEMENT OF PURPOSE RS07344 Idaho State Board of Optometry Amend existing statute to establish a penalty fee for reinstatement of a license to be $1 50.00 FISCAL IMPACT There is not fiscal impact to the General Fund. The Bureau reviewed the average number of cancelled licenses over the past three (3) years. With that number the fiscal impact would be: Average number of cancelled licenses 19 per year x $150 = $2,850 estimated increase in revenue. However, the legislation is designed to reduce the number of practitioners operating with an invalid license, so we do not anticipate the fiscal impact to be this high.
