S1433|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1433 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO HIGHWAYS; AMENDING SECTION 40-2316, IDAHO CODE, TO PROVIDE A STAN- 3 DARD FOR ROAD SIGNS ON PRIVATE HIGHWAYS. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. That Section 40-2316, Idaho Code, be, and the same is hereby 6 amended to read as follows: 7 40-2316. PRIVATE HIGHWAYS -- ESTABLISHMENT. Private highways may be 8 opened for the convenience of one or more residents of any county highway sys- 9 tem or highway district in the same manner as public highways are opened, 10 whenever the appropriate commissioners may order the highway to be opened. The 11 person for whose benefit the highway is required shall pay any damages awarded 12 to landowners, and keep the private highway in repair. Private highways 13 shall be identified by signage similar in design as stated in the manual on 14 uniform traffic control devices (MUTCD) for public street name signs, except 15 the signs shall be of white lettering on a blue background, and not deviate 16 from the size standards as stated in the MUTCD.
STATEMENT OF PURPOSE RS07937 This legislation provides for a uniform standard for designating private highways. Public highways are required to be identified with a sign having white letters on a green background in accordance with the Manual on Uniform Traffic Control Devices (MUTCD). Many counties in Idaho now require private highways to be posted with signs using white letters on a blue background, which corresponds to informational-type signs prescribed in the MUTCD, which is about as close as anything for the private sector. The private highway (road) sign distinguishes a privately maintained highway from one that is serviced and maintained by a governmental highway identification of a highway for emergency services, whether it be government or private.
