                                   SENATE BILL NO. 1475

 1                                        AN ACT
 2    RELATING TO SCHOOL BUSES; AMENDING SECTION 49-217, IDAHO CODE, TO REQUIRE THAT
 3        SCHOOL BUSES SHALL BE EQUIPPED WITH SEAT BELTS ON  AND  AFTER  JANUARY  1,
 4        1999.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION  1.  That  Section  49-217, Idaho Code, be, and the same is hereby
 7    amended to read as follows:

 8        49-217.  REGULATIONS RELATIVE TO SCHOOL BUSES. Any officer or employee  of
 9    any  school or school district operating a school bus who violates any regula-
10    tions promulgated in conformance with the provisions of section 49-201,  Idaho
11    Code,  may  be  guilty  of  misconduct  and  subject to removal from office or
12    employment. Any person operating a school bus under contract with a school  or
13    school  district  who  fails  to  comply with any regulations may be guilty of
14    breach of contract and such contract may be cancelled after notice of  hearing
15    by  the  responsible  officers  of the school or school district.  On and
16    after January 1, 1999, all school buses operated in this state by an  employee
17    or contractor of a school district shall be equipped with safety belts in com-
18    pliance  with  the  standards  enumerated in sections 49-672 and 49-673, Idaho
19    Code, and any school bus operated by an employee or  contractor  of  a  school
20    district on and after January 1, 1999, shall comply with the standards enumer-
21    ated  in those sections and all passengers riding on the school bus shall com-
22    ply with the standards and the duties set forth in those sections.

                            STATEMENT OF PURPOSE

    This proposal would require the installation and use of seat belts on all 
    school buses in Idaho.
    
                               FISCAL IMPACT
    
    In 1996-97, there were 2,440 school buses in Idaho. Based upon an 
    estimate of 50 belts required per bus and an installed cost of $40 per belt, the 
    first year cost would be $4,880,000. Assuming an annual replacement of twenty 
    percent (20%) per year, subsequent costs would be approximately $ 1,000,000 
    per year plus growth in students buses.
