 1                                        AN ACT
 2    RELATING TO THE APPROPRIATION OF GENERAL FUND MONEYS FOR PROPERTY TAX REPLACE-
 3        MENT; AMENDING SECTIONS 1, 2 AND 3, OF SENATE BILL 1555, AS ENACTED BY THE
 4        SECOND REGULAR SESSION OF THE FIFTY-FOURTH IDAHO LEGISLATURE; AND AMENDING
 5        SENATE BILL 1555,  AS  ENACTED  BY  THE  SECOND  REGULAR  SESSION  OF  THE
 6        FIFTY-FOURTH  IDAHO  LEGISLATURE,  BY  THE  ADDITION  OF A NEW SECTION, TO
 7        APPROPRIATE GENERAL FUND MONEYS TO PROPERTY TAX REPLACEMENT.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION 1.  That Sections 1, 2 and 3, of Senate Bill 1555, as  enacted  by
10    the Second Regular Session, of the Fifty-fourth Idaho Legislature, be, and the
11    same is hereby amended to read as follows:

12        SECTION  1.  It  is legislative intent that the following amounts shall be
13    expended from state sources for public schools for the period  July  1,  1998,
14    through June 30, 1999:

17     General Fund - Property Tax Replacement            54,700,000

19    Dedicated Funds:
20        Endowment Funds/Lands Receipts         $39,900,000
21        Mineral Royalties                        2,000,000
22        Liquor Fund                              1,200,000
23        Cigarette Tax                            5,000,000
24        Lottery Income Tax                         500,000
25        Miscellaneous Receipts                   2,100,000
26        Fund Balance                 3,500,000 
27             Total Dedicated Funds                     $ 54,200,000 
28        TOTAL                 $ 795,860,000  850,560,000 

29        SECTION  2.  There is hereby appropriated from the General Fund for public
30    schools, the following amount to be transferred to the  Public  School  Income
31    Fund for the period July 1, 1998, through June 30, 1999:
32    FROM:
33    General Fund              $ 741,660,000  796,360,000 

34        SECTION  3.  There  is  hereby  appropriated from the Public School Income
35    Fund to be expended for the Educational Support Program pursuant  to  law  and
36    the  provisions  of  this  act,  not  to exceed $ 795,860,000 
37    850,560,000  for the period July 1, 1998, through June 30, 1999.

38        SECTION 2.  That Senate Bill 1555, as enacted by the Second  Regular  Ses-
39    sion  of the Fifty-fourth Idaho Legislature, is hereby amended by the addition
40    of a  NEW SECTION , to read as follows:

 1        SECTION 20.  There is hereby appropriated from the  Public  School  Income
 2    Fund the amount necessary for property tax replacement, to be expended accord-
 3    ing to Section 33-1002D, Idaho Code, for the period July 1, 1998, through June
 4    30, 1999.

                         STATEMENT OF PURPOSE

    This legislation amends the public school appropriation to include the amount of property tax 
    replacement previously diverted directly from the sales tax. This a trailer bill for S.B. 1535 which 
    made the change to bring the property tax replacement money for public schools into the 
    appropriation process. As the result of that accounting change, the property tax replacement 
    money must now be included in the public school budget.
    
                                   
                                   
                              FISCAL NOTE
    
    
    
    There is no direct impact on the General Fund. Senate Bill 1535 causes the total General Fund 
    revenue to increase by $54.7 million and this legislation increases the public school 
    appropriation by the same amount.
