 1                                        AN ACT
 2    RELATING TO FARRAGUT STATE PARK; AMENDING  SECTION  67-4214,  IDAHO  CODE,  TO
 3        CHANGE  THE  LEGAL  DESCRIPTION OF FARRAGUT STATE PARK BY DELETING CERTAIN
 4        EXCEPTIONS THAT CURRENTLY ALLOW MANAGEMENT OF CERTAIN PARCELS  WITHIN  THE
 5        PARK BY THE DEPARTMENT OF FISH AND GAME AND TO MAKE TECHNICAL CORRECTIONS.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION  1.  That  Section 67-4214, Idaho Code, be, and the same is hereby
 8    amended to read as follows:

 9        67-4214.  FARRAGUT STATE PARK -- CREATED -- LOCATION. There is hereby cre-
10    ated a state park to be  known  and  designated  as  Farragut  State  Park  at
11    Bayview,  Kootenai  County, Idaho, located in a portion of the area heretofore
12    known and designated as the Farragut Wildlife Management Area,  consisting  of
13    about 2,900 acres, more or less, and more particularly described as follows:
14        "A  portion  of the facility formerly known as Farragut Naval Training and
15    Distribution Center, being a portion of fractional Sections 2, 3, 9 &  10  and
16    4,  5  and  8, Township 53 North, Range 2 West of the Boise Meridian, Kootenai
17    County, state of Idaho, more particularly described as follows:
18        "Commencing at a point on the southerly shore of  Idlewilde  Bay  of  Lake
19    Pend  d'Oreille,  said point being the meander corner common to Sections 9 and
20    10, Township 53 North, Range 2 West of the Boise Meridian, the real  point  of
21    the beginning; thence
22        "South  0<3'00"  East  894.96  feet along said section line to the section
23    corner common to Sections 9, 10, 15 & 16, Township 53 North, Range 2  West  of
24    the Boise Meridian; thence along the section line between said Sections 9 & 16
25        "North  87<57'26"  West  5426.89 feet to the section corner common to Sec-
26    tions 8, 9, 16 & 17, Township 53 North, Range 2 West of  the  Boise  Meridian;
27    thence along the section line between said Sections 8 & 17
28        "South  89<47'46"  West  5111.50 feet to the section corner common to Sec-
29    tions 7, 8, 17 & 18, Township 53 North, Range 2 West of  the  Boise  Meridian;
30    thence along the section line between said Sections 7 & 8
31        "North  0<31'00"  West  2650.80 feet to the 1/4 corner common to said Sec-
32    tions 7 & 8; thence continuing along said section line
33        "North 0<11'58" West 2648.75 feet to the section corner common to Sections
34    5, 6, 7 & 8, Township 53 North, Range 2 West of the Boise Meridian; thence
35        "North 82<37'38" East 1308.62 feet to a point that is 30.00  feet  to  the
36    left  (West) of a point on the North-South centerline of an access road, known
37    as "North Road", said  point  being  at  Engineers  Station:  P.C.  37  =
38      +  82.72;  thence  parallel  to  and 30.00 feet to the left
39    (Westerly & Northerly) of North Road centerline, the nineteen  (19)  following
40    courses and distances:
41        "Along  a  curve to the right, whose Central Angle is 44<15', whose Radius
42    is 168.53 feet, whose Degree of Curve is 34<00', a distance of 130.15 feet  to
43    a point; thence

37    Radius is 881.50 feet, whose Degree of Curve is 6<30', a distance of 862  feet
38    to  a point on said curve (said curve being a part of Blackwood Circle Road on
39    the Northerly edge of the Hospital Area of said Farragut  Naval  Training  and
40    Distribution  Center);  thence parallel to and 18.0 feet Northerly of the cen-
41    terline of said Blackwood Circle Road, the three  (3)  following  courses  and
42    distances: continuing
43        "Along  a  curve  to  the  right,  whose Central Angle is 33<58'15", whose
44    Radius is 881.50 feet, whose Degree of Curve is 6<30', a  distance  of  522.62
45    feet to a point; thence
46        "East 641.82 feet to a point on a curve; thence
47        "Along  a  curve  to the right, whose Radius is 1910 feet, whose Degree of
48    Curve is 3<00', a distance of 35 feet, more or less, to a point that is  South
49    62<48' East 187.50 feet and South 34<23' West 865 feet from the meander corner
50    common to Section 3, Township 53 North, Range 2 West of the Boise Meridian and
51    Section  34,  Township  54  North,  Range  2  West  of  the Boise Meridian, as
52    described in Parcel 1 of Exceptions in that certain Deed, by and  between  the
53    United States of America and the state of Idaho, recorded under Instrument No.
54    235294, records of Kootenai County, state of Idaho; thence
55        "North  34<23' East 865 feet along the aforementioned course to a point on

 4    Point, Idlewilde and Buttonhook Bays of Lake Pend d'Oreille to  the  point  of

 6        "EXCEPTING from the above described land:
 7        (1) "Those certain three (3) tracts of land lying  in  Sections
 8    2  & 3, Township 53 North, Range 2 West of the Boise Meridian, as described in
 9    Parcels 2, 3 & 7 of EXCEPTIONS under part I  of  that  certain  Deed,  by  and
10    between  the  United  States of America and the state of Idaho, recorded under
11    Instrument No. 235294, records of Kootenai County, state of Idaho ,
12        (2) "Those certain seven (7) tracts of land lying in Sections 2, 3  &  10,
13    Township  53  North,  Range 2 West of the Boise Meridian, as described in Par-
14    cels: 51A, 51B, 51C, 53, 54, 55 & 56 in that certain Deed, by and between  the
15    United States of America and the state of Idaho, recorded under Instrument No.
16    230238, records of Kootenai County, state of Idaho,
17        (3)  "Those certain two (2) tracts of land lying in Section 9, Township 53
18    North, Range 2 West of the Boise Meridian, as described in  the  second  para-
19    graph  of  that  certain  Quitclaim  Deed, by and between the United States of
20    America and the state of Idaho, recorded under Instrument No. 229734,  records
21    of Kootenai County, state of Idaho ."

                          STATEMENT OF PURPOSE

    This proposed legislation will transfer management control of 
    several small parcels of land within the boundaries of Farragut 
    State Park, from the Department of Fish and Game to the Department 
    of Parks and Recreation. The park lands, after being declared 
    surplus property by the U.S. Government were quit claimed deeded 
    to the State of Idaho in piecemeal. Management control is divided 
    between two state agencies. This bill will provide that nine 
    separate parcels of land, now controlled by Fish and Game, will 
    instead be controlled by Parks and Recreation. Said parcels are 
    surrounded by park lands actively administered. This transfer will 
    result in more effective, efficient, and specific management of 
    state lands.
