 1                                        AN ACT
 2    RELATING TO RECORDING FEES; AMENDING SECTION 31-3205, IDAHO CODE,  TO  PROVIDE
 3        FOR  AN  INCREASE IN FEES FOR RECORDING THE FIRST PAGE OF A DOCUMENT FOR A
 4        FIVE YEAR PERIOD, AND TO PROVIDE FOR A  DEDICATED  TECHNOLOGY  ACCOUNT  TO
 5        FUND  AND  SUPPORT MAINTENANCE, UPGRADES AND PURCHASES OF EQUIPMENT, TECH-
 6        NOLOGY AND RELATED EXPENSES FOR COUNTY LAND  RECORDS  WHICH  SHALL  BE  IN
 7        EFFECT FOR A FIVE YEAR PERIOD.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION  1.  That  Section 31-3205, Idaho Code, be, and the same is hereby
10    amended to read as follows:

11        31-3205.  RECORDER'S  FEES.    (1)    The  county  recorder  is
12    allowed, and may receive for his services, the following fees, to be paid  him
13    by the party procuring his services:
14          For  recording every instrument, paper or notice for the first page
15    until June 30, 2003 ................................................... $ 8.00
16         For recording every instrument, paper or  notice,  for  each  
17    subsequent  page  until June 30, 2003  .............. $  3.00
18          On and after July 1, 2003, for recording every instrument, paper or
19    notice for each page .................................................. $ 3.00
20         For copies of any record or paper, for each page ........... $ 1.00
21        For each certificate under seal, when required .................... $ 1.00
22        For release or assignment where more than one (1) document is released  or
23    assigned in the same instrument, for each additional release or assignment....
24    ....................................................................... $ 1.00
25        For recording every town plat or map, for first one hundred (100) lots  or
26    less .................................................................. $11.00
27        And for each additional lot ....................................... $  .05
28        For taking acknowledgments, including seal ........................ $ 1.00
29        For recording the location notice or amended location notice, of a mining
30     claim, or for recording and indexing each notice, for each page ...... $ 3.00
31        For recording affidavit of labor of mining claims for one (1) mining claim
32    ....................................................................... $ 4.00
33        Plus an additional charge for each claim in excess of one (1) ..... $  .50
34        For filing a survey ............................................... $ 5.00
35        For making a copy of a survey or highway right-of-way plat ........ $ 4.00
36        For issuing marriage license, filing, recording and indexing the
37    certificate of marriage and taking and filing affidavits required in
38    issuance of the license ............................................... $11.00
39        For administering an oath, including jurat ........................ $ 1.00
40        And certifying the same when required an additional sum of ........ $ 1.00
41        For comparing and certifying a prepared copy of a file or record in his
42     office, for each page ................................................ $  .50
43        For making and certifying a report of search for lien upon personal

 1     property, excluding Uniform Commercial Code, for each name searched .. $ 5.00
 2        For  each  certificate  under  seal  there  shall  be an additional fee of
 3    ....................................................................... $ 1.00
 4        All instruments delivered to the  county  recorder  for  record  shall  be
 5    recorded  rather  than filed with the exception of plats, surveys, cornerstone
 6    markers and instruments under the Uniform Commercial Code.
 7        For all other services as recorder, not enumerated herein, the  fee  fixed
 8    in  the  statute requiring the service or the same fee as allowed the clerk of
 9    the district court for like service.
10        A page shall not exceed fourteen (14) inches in length nor eight and  one-
11    half  (8  1/2)  inches  in  width.  The  recording fee to be charged for maps,
12    sketches, drawings or other instruments except plats larger than the size per-
13    mitted above for a page shall be two cents (2[) per square inch.
14         (2)  From July 1, 1998, until June 30, 2003,  five  dollars  ($5.00)
15    from  the  recording of the first page of  every instrument shall be deposited
16    in a dedicated technology account  to fund and support  maintenance,  upgrades
17    and  purchases  of  equipment, technology and related expenses for county land
18    records.

                           STATEMENT OF PURPOSE

    The purpose of this legislation is to provide funding to 
    support the costs associated with recording and long-term storing of 
    public records. The proposed dedicated technology account would fund 
    and support maintenance, upgrades and purchases of equipment, 
    technology and related expenses for county land records. This 
    legislation has a sunset clause of June 30, 2003.
    
                                FISCAL NOTE
    
    This legislation has a fee increase from $3 to $8 for the first 
    page and would have a total impact statewide of approximately $1.7 
    million.
