 1                                        AN ACT
 2    RELATING TO EMERGENCY MEDICAL SERVICES; AMENDING CHAPTER 1,  TITLE  39,  IDAHO
 3        CODE,  BY  THE ADDITION OF A NEW SECTION 39-146B, IDAHO CODE, TO ESTABLISH
 4        THE EMERGENCY MEDICAL SERVICES ACCOUNT III AND TO PROVIDE THAT THE  BUREAU
 5        OF  EMERGENCY  MEDICAL  SERVICES  OF  THE DEPARTMENT OF HEALTH AND WELFARE
 6        SHALL BE RESPONSIBLE FOR DISTRIBUTION OF GRANTS FROM THE ACCOUNT TO QUALI-
 7        FIED APPLICANTS; AMENDING SECTION 49-306, IDAHO CODE, TO INCREASE THE FEES
 8        FOR DRIVERS' LICENSES AND COMMERCIAL DRIVER  INSTRUCTION  PERMITS  AND  TO
 9        PROVIDE FOR DISTRIBUTION OF THE INCREASE TO THE EMERGENCY MEDICAL SERVICES
10        ACCOUNT III; PROVIDING LEGISLATIVE REVIEW; PROVIDING AN EFFECTIVE DATE FOR
11        SECTIONS  1 AND 3 OF THIS ACT; AND PROVIDING AN EFFECTIVE DATE FOR SECTION
12        2 OF THIS ACT.

13    Be It Enacted by the Legislature of the State of Idaho:

14        SECTION 1.  That Chapter 1, Title 39, Idaho Code,  be,  and  the  same  is
15    hereby  amended  by  the addition thereto of a  NEW SECTION , to be
16    known and designated as Section 39-146B, Idaho Code, and to read as follows:

17        39-146B.  EMERGENCY MEDICAL SERVICES ACCOUNT  III.  (1)  There  is  hereby
18    created  in  the  dedicated fund of the state treasury an account known as the
19    emergency medical services account III. Subject to appropriation by the legis-
20    lature, moneys in the account shall be used exclusively  for  the  purpose  of
21    acquiring vehicles and equipment for use by emergency medical services person-
22    nel  in the performance of their duties which include highway safety and emer-
23    gency response to motor vehicle accidents.
24        (2)  The bureau of emergency medical services of the department of  health
25    and  welfare  shall be responsible for distributing moneys from the account to
26    qualifying nonprofit and governmental entities that submit an application  for
27    a grant from the account. The bureau shall approve grants based on the follow-
28    ing criteria:
29        (a)  The  requesting  entity  is  a nonprofit or governmental entity which
30        holds a current license as an ambulance or nontransport service issued  by
31        the state of Idaho;
32        (b)  The  requesting entity has demonstrated need based on criteria estab-
33        lished by the bureau;
34        (c)  The requesting entity has provided verification that it has  received
35        the approval and endorsement of a city or county within its service area;
36        (d)  The  requesting  entity  has  certified that the title to any vehicle
37        purchased with funds from the account shall be in the name of the city  or
38        county which endorsed the application and shall submit proof of titling as
39        soon as practicable.
40        (e)  The state of Idaho shall retain a security interest in the vehicle to
41        secure  the performance of the grant recipient to utilize the vehicle con-
42        sistent with the intent described in the application.
43        (3)  Notwithstanding the requirements of subsections (2)(c) and (2)(d)  of

 1    this  section,  the  bureau  of  emergency  medical  services is authorized to
 2    approve and issue a grant to an applicant in the absence of an endorsement  if
 3    the endorsement is withheld without adequate justification.

 4        SECTION  2.  That  Section  49-306, Idaho Code, be, and the same is hereby
 5    amended to read as follows:

 6        49-306.  APPLICATION FOR DRIVER'S LICENSE OR INSTRUCTION PERMIT. (1) Every
 7    application for an instruction permit or for a driver's license shall be  made
 8    upon a form furnished by the department and shall be verified by the applicant
 9    before  a person authorized to administer oaths. Officers and employees of the
10    department and sheriffs and their deputies are authorized  to  administer  the
11    oaths without charge. Every application for a permit or driver's license shall
12    be accompanied by the following fee, none of which is refundable:
13        (a)  Class A, B, C license with endorsements ..... $2 4  8

31        (2)  Every  application shall state the full name, date of birth, place of
32    birth, sex, Idaho residence address and mailing address, if different, of  the
33    applicant, height, weight, hair color, and eye color, and for a class A, B, or
34    C  driver's  license or seasonal driver's license the applicant's social secu-
35    rity number as verified by the applicant's social security  card.  A  driver's
36    license  or  instruction permit issued on and after January 1, 1993, shall not
37    contain an applicant's social security number. Applications on file  shall  be
38    exempt  from disclosure except as provided in sections 49-202, 49-203, 49-203A
39    and 49-204, Idaho Code. Every application shall also state whether the  appli-
40    cant  has  previously  been  licensed as a driver, and if so, when and by what
41    state or country, and whether a driver's license or privileges have ever  been
42    suspended,  revoked, denied, disqualified, cancelled or whether an application
43    has ever been refused, and if so, the date of and reason for  the  suspension,
44    revocation,   denial,   disqualification,  cancellation  or  refusal  and  the
45    applicant's  oath  that  all  information  is  correct  as  signified  by  the
46    applicant's signature. The applicant may be required to submit proof of  iden-
47    tity  and date of birth as set forth in a certified copy of his birth certifi-
48    cate and other satisfactory evidence to satisfy the  issuing  officer  or  the
49    department.  If an applicant for a driver's training instruction permit cannot
50    provide a certified copy of his birth certificate at the time of  application,
51    the  department  may issue a temporary driver's training instruction permit in
52    accordance with the provisions of section 49-305, Idaho Code.
53        (3)  Whenever an application is received from a person previously licensed

 1    in another jurisdiction, the department shall request a copy of  the  driver's
 2    record  from the other jurisdiction and shall contact the national driver reg-
 3    ister. When received, the driver's record from the previous jurisdiction shall
 4    become a part of the driver's record in this state with  the  same  force  and
 5    effect  as though entered on the driver's record in this state in the original
 6    instance.
 7        (4)  Whenever the department receives a request for a driver's record from
 8    another licensing jurisdiction, the record shall be forwarded without charge.
 9        (5)  The department shall contact and notify the commercial driver license
10    information system of the proposed application for a class A, B or C  driver's
11    license  to  insure  identification  of  the person and to obtain clearance to
12    issue the license.
13        (6)  When the fees required under this section are collected by  a  county
14    officer,  they  shall be paid over to the county treasurer not less often than
15    monthly, who shall immediately:
16        (a)  Deposit an amount equal to five dollars ($5.00)  from  each  driver's
17        license  or  instruction permit application fees, application for a dupli-
18        cate driver's license or permit, classification change, seasonal  driver's
19        license and additional endorsement in the current expense fund; and
20        (b)  Deposit  two  dollars  and  fifty  cents ($2.50) from each motorcycle
21        endorsement and motorcycle endorsement instruction permit fee in the  cur-
22        rent expense fund; and
23        (c)  Deposit  an amount equal to three dollars ($3.00) from each fee for a
24        knowledge test in the current expense fund; and
25        (d)  Deposit an amount equal to five dollars ($5.00) from each fee  for  a
26        motorcycle  endorsement  skills test in the current expense fund; provided
27        however, if a contractor administers the skills test he shall be  entitled
28        to the five dollar ($5.00) fee;
29        (e)  Remit the remainder to the state treasurer; and
30        (f)  Deposit  eleven  dollars and fifty cents ($11.50) from each fee for a
31        class D skills test into the county current expense fund, unless the  test
32        is  administered  by  a  department-approved contractor, in which case the
33        contractor shall be entitled to eleven dollars and fifty cents ($11.50) of
34        each fee.
35        (7)  When the fees required under this section are collected  by  a  state
36    officer or agency, they shall be paid over to the state treasurer.
37        (8)  The  state  treasurer  shall distribute the moneys received from fees
38    imposed by the provisions of this section, whether collected by a county offi-
39    cer or by a state officer or agency as follows:
40        (a)  Two dollars ($2.00) of each fee for a driver's  license  or  seasonal
41        driver's  license  shall  be  deposited  in the emergency medical services
42        account II created in section 39-146A, Idaho Code , and four  dollars
43        ($4.00)  of each such fee shall be deposited in the emergency medical ser-
44        vices account III created in section 39-146B, Idaho Code ; and
45        (b)  Sixteen dollars and fifty cents ($16.50) of each fee for  a  seasonal
46        or class A, B, or C driver's license shall be deposited in the state high-
47        way account; and
48        (c)  Ten dollars and fifty cents ($10.50) of each fee for a class A, B, or
49        C  instruction  permit  or driver's license classification change shall be
50        deposited in the state highway account; and
51        (d)   Four dollars ($4.00) of each  fee  for  a  class  A,  B,  or  C
52        instruction  permit  shall  be deposited in the emergency medical services
53        account III created in section 39-146B, Idaho Code; and
54        (e)   Six dollars and fifty cents ($6.50) of each fee for  a  dupli-
55        cate  seasonal  or  class  A,  B,  or C driver's license, class A, B, or C

 1        driver's license extension, or additional endorsement shall  be  deposited
 2        in the state highway account; and
 3        (  e    f  )  Four dollars ($4.00) of each fee for a
 4        motorcycle endorsement and motorcycle endorsement instruction permit shall
 5        be deposited in the state highway account; and
 6        ( f  g )  Five dollars and thirty cents  ($5.30)  of
 7        each  fee  for a class D driver's license shall be deposited in the driver
 8        training account; and
 9        ( g  h )  Seven dollars and twenty cents ($7.20)  of
10        each  fee for a class D driver's license shall be deposited in the highway
11        distribution account; and
12        ( h  i )  Two dollars and  sixty  cents  ($2.60)  of
13        each  fee  for  a class D instruction permit, duplicate class D license or
14        permit, and class D license extension shall be  deposited  in  the  driver
15        training account; and
16        (  i  j )  Three dollars and ninety cents ($3.90) of
17        each fee for a class D instruction permit, duplicate class  D  license  or
18        permit,  and  class  D license extension shall be deposited in the highway
19        distribution account; and
20        ( j  k )  Five dollars ($5.00) of  each  fee  for  a
21        class  A,  B,  or  C  skills  test shall be deposited in the state highway
22        account; and
23        ( k  l )  One dollar ($1.00) of each fee for a class
24        A, B, C or D driver's license shall be deposited in the motorcycle  safety
25        program fund established in section 33-4804, Idaho Code.
26        (  l   m )  Three dollars and fifty cents ($3.50) of
27        each fee for a class D skills test shall be deposited into the state high-
28        way account.
29        (9)  The contractor administering a class A, B, or C skills test shall  be
30    entitled  to  thirty  dollars  ($30.00)  of  the skills test fee. A contractor
31    administering a class A, B, or C skills test may collect an additional fee for
32    the use of the contractor's vehicle for the skills test.
33        (10) The department may issue seasonal class  B  or  C  driver's  licenses
34    that:
35        (a)  Will  only  be  valid  for  driving commercial vehicles that normally
36        require class B or C commercial driver's licenses;
37        (b)  Will be valid for seasonal periods that begin on the date of issuance
38        and that are not to exceed one hundred eighty (180) days in a twelve  (12)
39        month period;
40        (c)  May only be obtained twice in a driver's lifetime;
41        (d)  Are  valid  only  within a one hundred fifty (150) mile radius of the
42        place of business or farm being serviced; and
43        (e)  Will be valid only in conjunction with valid Idaho class  D  driver's
44        licenses.
45        (11) The  department  may issue seasonal class B or C driver's licenses to
46    drivers who:
47        (a)  Have not violated the single license provisions of 49 CFR part 383;
48        (b)  Have not had any license suspensions, revocations or cancellations;
49        (c)  Have not had any convictions in any vehicle for any offense listed in
50        section 49-335(1) or 49-335(2), Idaho Code, or any one (1) serious traffic
51        offense;
52        (d)  Have at least one (1) year of driving experience with a  class  D  or
53        equivalent license in any type motor vehicle; and
54        (e)  Are at least sixteen (16) years old.

 1        SECTION  3.  LEGISLATIVE  REVIEW. It is the intent of the legislature that
 2    the director of the Department of Health and Welfare shall be responsible  for
 3    submitting  a  report  on the effectiveness of the provisions of this act. The
 4    report shall be submitted to the First Regular Session  of  the  Fifty-seventh
 5    Idaho  Legislature  no  later than January 13, 2003. The report shall include:
 6    the amount of revenue which has accrued to the account in each fiscal year,  a
 7    detailed accounting of the distribution of moneys from the account, a determi-
 8    nation  of whether administration of the account is cost-effective, an evalua-
 9    tion of the extent to which moneys appropriated from the account have contrib-
10    uted to the purposes for which the account  was  established,  and  any  other
11    information which will assist the legislature in its review.

12        SECTION  4.  Sections  1 and 3 of this act shall be effective on and after
13    July 1, 1998.

14        SECTION 5.  Section 2 of this act shall be effective on and after  January
15    1, 1999.

    dedicated to the purpose of acquiring vehicles and equipment 
    for emergency medical services personnel in the performance 
    of their duties which include highway safety and emergency 
    response to motor vehicle accidents. Sets the requirements 
    for grant application and approval; adds $4.00 EMT fee to 
    all driver's licenses, A, B & C instruction permits and 
    seasonal driver's license and provides deposit of said funds 
    in the emergency medical services account III. Establishes 
    legislative review on the effectiveness of these provisions 
    to be reported in 5 years, January 13, 2003 to the 57th 
    legislature.
    
                               FISCAL NOTE
    
    The amendment providing for an increase in driver's license 
    fees and to be deposited in a separate EMS Account will 
    affect the Idaho Transportation Department's automated 
    computer system.
    
    An estimated one-time contractor cost to modify the 
    required programs will be $4,275.00
