                            BY AGRICULTURAL AFFAIRS COMMITTEE

 1                                        AN ACT
 2    RELATING TO  BONDED  WAREHOUSES;  AMENDING  SECTION  69-261,  IDAHO  CODE,  TO
 3        INCREASE THE NUMBER OF MEMBERS ON THE COMMODITY INDEMNITY ACCOUNT ADVISORY
 4        COMMITTEE  AND TO PROVIDE THAT THE COMMITTEE SHALL BE COMPOSED OF SIX PRO-
 5        DUCERS PRIMARILY ENGAGED  IN  THE  PRODUCTION  OF  COMMODITIES  AND  THREE
 6        LICENSED BONDED WAREHOUSEMEN OR LICENSED COMMODITY DEALERS.

 7    Be It Enacted by the Legislature of the State of Idaho:

 8        SECTION  1.  That  Section  69-261, Idaho Code, be, and the same is hereby
 9    amended to read as follows:

10        69-261.  ADVISORY COMMITTEE -- TERMS -- COMPENSATION. (1)  There is hereby
11    created a commodity indemnity account advisory committee consisting  of  
12    five (5)   nine (9)  members to be appointed by the director.
13      The director shall make appointments to the committee no later than the
14    effective date of the program. Of the initial appointments, two (2)  shall  be
15    for two (2) year terms and three (3) shall be for three (3) year terms. There-
16    after,  a    A ppointments shall be for three (3) year terms,
17    each term ending on the same day of the same month as did the  term  preceding
18    it.  Any  member appointed to fill a vacancy occurring prior to the expiration
19    of the term for which the member's predecessor was appointed shall hold office
20    for the remainder of the predecessor's term.
21        (2)  The committee shall be composed of  three (3)     six
22    (6)    producers primarily engaged in the production of commodities, and
23     two (2)   three (3)  licensed    commodity  
24     bonded  warehousemen or licensed commodity dealers.
25        (3)  The  committee shall meet at such places and times as it shall deter-
26    mine and as often as necessary to discharge the duties imposed upon  it,  pro-
27    vided,  it shall meet not less than once per year. Each committee member shall
28    be compensated in accordance with section 59-509(g), Idaho  Code,  for  travel
29    and subsistence expense. The expenses of the committee and its operation shall
30    be paid from the commodity indemnity account.
31        (4)  The  committee  shall  have the power and duty to advise the director
32    concerning assessments, administration of the commodity indemnity account, and
33    payment of claims from the account.

                          STATEMENT OF PURPOSE

    Increasing the size of the Commodity Indemnity Account 
    Program (CIAP) committee will assure a quorum 
    proportionately representing both producers and industry. 
    With the failures that have occurred in 50% of the cases, 
    one member has had a conflict of interest, which had 
    reduced the size of the committee.
    
                               FISCAL NOTE
    
    Current committee members are reimbursed under 59-509(g), 
    Idaho Code. Members receive $35 per day plus reimbursement 
    for necessary expenses, which are subject to the limits 
    provided in Section 67-2008, Idaho Code.
    
    Currently, the CIAP committee meets at least once a year, 
    which results in a fiscal impact on the CIAP of 
    approximately $850. This includes transportation, per diem 
    and motel, if necessary. If additional meetings were held, 
    the cost would
    
    increase.
