                            HOUSE CONCURRENT RESOLUTION NO. 47

                                BY STATE AFFAIRS COMMITTEE

 1                               A CONCURRENT RESOLUTION
 2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING A CERTAIN  PENDING  RULE  OF
 3        THE  DIVISION  OF BUILDING SAFETY RELATING TO ELECTRICAL SPECIALTY LICENS-
 4        ING, AND SPECIFYING THAT THE  CORRESPONDING  TEMPORARY  RULE  RELATING  TO
 5        ELECTRICAL  SPECIALTY  LICENSING NOT BE EXTENDED BEYOND THE ADJOURNMENT OF
 6        THE SECOND REGULAR SESSION OF THE FIFTY-FOURTH IDAHO LEGISLATURE.

 7    Be It Resolved by the Legislature of the State of Idaho:

 8        WHEREAS, the legislature is vested  with  authority  to  reject  executive
 9    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
10    that  the legislature finds that the rules are not consistent with legislative
11    intent; and
12        WHEREAS, it is the finding of the legislature that a certain pending  rule
13    of  the Division of Building Safety relating to electrical specialties requir-
14    ing a special license and the corresponding temporary rule relating  to  elec-
15    trical  specialties requiring a special license are not consistent with legis-
16    lative intent and should be rejected.
17        NOW, THEREFORE, BE IT RESOLVED by the members of the Second  Regular  Ses-
18    sion  of  the Fifty-fourth Idaho Legislature, the House of Representatives and
19    the Senate concurring therein, that IDAPA 07.01.04.014, rules of the  Division
20    of  Building  Safety  relating  to  electrical specialties requiring a special
21    license, adopted as a pending rule under Docket number 07-0104-9701,  be,  and
22    the  same  is  hereby  rejected  and  declared  null, void and of no force and
23    effect.
24        BE IT FURTHER RESOLVED by the members of the Second Regular Session of the
25    Fifty-fourth Idaho Legislature, the House of Representatives  and  the  Senate
26    concurring therein, that IDAPA 07.01.04.014, rules of the Division of Building
27    Safety relating to electrical specialties requiring a special license, adopted
28    as  a  temporary  rule under Docket number 07-0104-9701, and made effective by
29    the Division of Building Safety on July 1, 1997,  be, and the same  is  hereby
30    rejected,  and  notwithstanding  any  other concurrent resolutions to the con-
31    trary, the same is not approved and  not  extended  and  pursuant  to  Section
32    67-5226,  Idaho  Code, shall be declared null, void and of no force and effect
33    upon adjournment of the Second Regular Session of the Fifty-fourth Idaho  Leg-
34    islature.

                           STATEMENT OF PURPOSE
    
                                 RS 08177
    
    This resolution would reject a pending rule of the Division of 
    Building Safety, which deals with electrical specialities 
    requiring a special license. If adopted, this resolution would 
    prevent the pending rule from going into effect. The 
    resolution also would keep a temporary rule concerning 
    electrical specialty licensing that went into effect on July 
    1, 1997, from being extended beyond the adjournment of the 1998 
    Legislative Session.

    This resolution would have no fiscal impact.
