S1386|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1386 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE PUBLIC UTILITIES COMMISSION; AMENDING SECTION 61-206, IDAHO 3 CODE, TO PROVIDE THAT REGULATORY POLICY STRATEGISTS OF THE PUBLIC UTILI- 4 TIES COMMISSION SHALL BE NONCLASSIFIED EMPLOYEES AND REPORT DIRECTLY TO 5 THE COMMISSION; AND DECLARING AN EMERGENCY. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 61-206, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 61-206. EMPLOYEES. (1) The commission shall have power to 10 employ, during its pleasure, such officers, experts, engineers, statisticians, 11 accountants, inspectors, clerks and employees as it may deem necessary to 12 carry out the provisions of this act or to perform the duties and exercise the 13 powers conferred by law upon the commission. 14 (2) In addition to the number of nonclassified employees provided 15 by other provisions of law, the commission shall have the authority to employ 16 not more than three (3) nonclassified employees as regulatory policy 17 strategists reporting directly to the commission. 18 SECTION 2. An emergency existing therefor, which emergency is hereby 19 declared to exist, this act shall be in full force and effect on and after its 20 passage and approval.
STATEMENT OF PURPOSE

Amends Idaho Code 61-206 to allow up to three policy strategists
of the Public Utilities Commission to be nonclassified
employees.
FISCAL IMPACT
There is no fiscal impact to the General Fund. Commission
expend tures are paid with appropriations from the public
utilities commission fund. This addition would have an impact
on the public utilities fund of $173,200 for FY99.
Under current Idaho law, utilities may be assessed a maximum
fee of 3/10 of 1% of their gross intrastate utility revenue to
operate the Public Utilities Commission. This increase would
not cause an
in the maximum assessment level or an increase in
utility
