                        HOUSE BILL NO. 5, As Amended in the Senate

 1                                        AN ACT
 2    RELATING TO THE INSURANCE CODE; AMENDING SECTION 41-117, IDAHO CODE, TO AUTHO-
 3        RIZE AN ADMINISTRATIVE PENALTY FOR VIOLATIONS OF THE  INSURANCE  CODE  NOT
 4        GOVERNED BY SPECIFIC PENALTY PROVISIONS.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION  1.  That  Section  41-117, Idaho Code, be, and the same is hereby
 7    amended to read as follows:

 8        41-117.  GENERAL PENALTY. Each violation of this code for which a  greater
 9    penalty is not provided by another provision of this code or by other applica-
10    ble laws of this state, shall in addition to any applicable prescribed denial,
11    suspension, or revocation of certificate of authority or license be punishable
12      by  an  administrative  penalty  of  not more than one thousand dollars
13    ($1,000) for any individual or natural person and not more than five  thousand
14    dollars  ($5,000)  for  any  other person, imposed by the director, and 
15    upon conviction by a fine of not more than one thousand dollars ($1,000) or by
16    imprisonment in the county jail for a period not to exceed six (6) months,  or
17    by  both  such  fine  and  imprisonment  in  the discretion of the court. Each
18    instance of violation may be considered a separate offense.

                                      IN THE SENATE
                              SENATE AMENDMENT TO H.B. NO. 5

 1                               AMENDMENTS TO SECTION 1
 2        On page 1 of the printed bill, in line 12,  following  "  penalty  of
 3    "  insert:  "  not  more than one thousand dollars ($1,000) for any
 4    individual or natural person and ";  and  also  in  line  12,  following
 5    " ($5,000) " insert: " for any other person ".

Statement of Purpose / Fiscal Impact


                      STATEMENT  OF  PURPOSE
                             RS08350
Idaho Code, Section 41-117, imposes a general criminal penalty for
violation of the insurance code, but does not include an
administrative penalty.

The amendments to this section will provide for a general
administrative penalty in addition to the existing general criminal
penalty.
