 1                                        AN ACT
 2    RELATING TO FISH AND GAME; AMENDING SECTION 36-406A, IDAHO CODE, TO ALLOW RES-
 3        IDENTS UNDER FOURTEEN YEARS OF AGE TO USE TWO FISHING POLES; DECLARING  AN
 4        EMERGENCY AND PROVIDING RETROACTIVE APPLICATION.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION  1.  That  Section 36-406A, Idaho Code, be, and the same is hereby
 7    amended to read as follows:

 8        36-406A.  TWO POLE VALIDATION. The commission is authorized to  promulgate
 9    rules  specifying seasons and waters where a resident or nonresident may apply
10    for a validation to be placed on their fishing license authorizing the  person
11    to  use two (2) poles on waters that have been designated as "two pole" waters
12    by commission rule subject to payment of a seven dollar and fifty cent ($7.50)
13    fee. A person who has a validation  and  residents  under  fourteen  (14)
14    years  of  age  may utilize two (2) poles to fish with during the season
15    so specified by commission rule and on the waters so specified  by  commission
16    rule.  The fee imposed by this section shall be deposited in the fish and game
17    account.

18        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
19    declared to exist, this act shall be in full force and effect on and after its
20    passage and approval, and retroactively to January 1, 1999.

                      STATEMENT  OF  PURPOSE

This legislation will allow resident children under fourteen years
of age to use two poles for fishing without purchasing a two pole
validation. Currently, these children are unable to purchase a
license or a two pole validation, or utilize two poles while
fishing.
