PUBLIC WORKS CONTRACTORS LICENSE BOARD - Amends existing law to provide
that fees collected by the Public Works Contractors License Board shall be
paid to the board and that expenses shall be paid from the board fund.

                                    HOUSE BILL NO. 63

                Requested by: Public Works Contractors State License Board

 1                                        AN ACT
 2    RELATING TO THE PUBLIC WORKS CONSTRUCTION MANAGEMENT LICENSING  ACT;  AMENDING
 3        SECTION  54-4510, IDAHO CODE, TO PROVIDE THAT FEES COLLECTED BY THE PUBLIC
 4        WORKS CONTRACTORS LICENSE BOARD SHALL BE PAID TO  THE  BOARD  AND  TO  THE
 5        CREDIT  OF THE BOARD FUND, AND THAT EXPENSES SHALL BE PAID FROM THE PUBLIC
 6        WORKS CONTRACTORS LICENSE BOARD FUND.

 7    Be It Enacted by the Legislature of the State of Idaho:

 8        SECTION 1.  That Section 54-4510, Idaho Code, be, and the same  is  hereby
 9    amended to read as follows:

10        54-4510.  FEES  -- DISPOSITION OF FUNDS. (1) The board shall adopt by rule
11    reasonable fees not to exceed two hundred dollars ($200) for each of the  fol-
12    lowing:
13        (a)  Initial examination and licensing;
14        (b)  License renewal;
15        (c)  Inactive licenses;
16        (d)  License reinstatement; and
17        (e)  Issuance, suspension and reinstatement of a certificate of authority.
18        (2)  All  fees collected by the board shall be paid to the  bureau of
19    occupational licenses    public  works  contractors  license  board
20     and deposited in the state treasury, to the credit of the  occupa-
21    tional  licenses      public works contractors license board 
22    fund, and shall be used only for the administration of the provisions of  this
23    chapter.  All  expenses  incurred  pursuant  to the provisions of this chapter
24    shall be paid from the  occupational licenses    public  works
25    contractors  license  board  fund. All fees collected by the board under
26    the provisions of this chapter are hereby appropriated for one (1)  year  fol-
27    lowing  the effective date of this chapter and thereafter as appropriated each
28    year by the legislature for carrying out the purposes and objectives  of  this
29    chapter  and  to  pay all costs and expenses incurred in connection therewith.
30    Such moneys shall be paid out on warrants drawn by the state  controller  upon
31    presentation of proper vouchers approved by the board.

Relating  to licensing of construction managers:  amending Section
54-4510 to clarify that monies received are  deposited to the
Public Works Contractors License Board Fund since that is the
licensing agency.

This section was overlooked when the legislation was originally
written and revised.
