                                    HOUSE BILL NO. 184

                                BY STATE AFFAIRS COMMITTEE

 1                                        AN ACT
 2    RELATING TO THE  IDAHO  HOUSING  AND  FINANCE  ASSOCIATION;  AMENDING  SECTION
 3        67-6226,  IDAHO  CODE,  TO PROVIDE THAT THE RECORDS OF THE ASSOCIATION ARE
 4        SUBJECT TO PUBLIC DISCLOSURE PURSUANT TO CHAPTER 3, TITLE 9, IDAHO CODE.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION 1.  That Section 67-6226, Idaho Code, be, and the same  is  hereby
 7    amended to read as follows:

 8        67-6226.  DISCLOSURE  OF RECORDS. It is recognized that the association is
 9     not, and has not been since its inception, a state or local  agency  for
10    purposes  of  Idaho  law  including   a public body and pursuant to
11     chapter 3, title 9, Idaho Code ,   Therefore, in  order
12    to  assure  reasonable public disclosure of its records, the association shall
13    prepare and maintain a written policy, acceptable in form and content  to  the
14    governor,  providing for the disclosure of its records to the public. Prior to
15    such policy or any amendments  thereto  becoming  effective,  the  association
16    shall submit the same to the governor for his written approval   is
17    subject to public disclosure of its records .

                          The purpose of this legislation is to remove the public
disclosure exemption for the Idaho Housing and Finance
Association.
