 1                                        AN ACT
 2    RELATING TO MILITARY SELECTIVE SERVICE REGISTRATION; AMENDING TITLE 46,  IDAHO
 3        CODE, BY THE ADDITION OF A NEW CHAPTER 5, TITLE 46, IDAHO CODE, TO PROVIDE
 4        THE  PURPOSE  OF  THE CHAPTER, TO PROVIDE LEGISLATIVE FINDINGS, TO PROVIDE
 5        ELIGIBILITY FOR POSTSECONDARY EDUCATION AND FOR FINANCIAL  ASSISTANCE,  TO
 6        PROVIDE ELIGIBILITY FOR EMPLOYMENT AND TO PROVIDE EXCEPTIONS.

 7    Be It Enacted by the Legislature of the State of Idaho:

 8        SECTION  1.  That Title 46, Idaho Code, be, and the same is hereby amended
 9    by the addition thereto of a  NEW CHAPTER , to be known and  desig-
10    nated as Chapter 5, Title 46, Idaho Code, and to read as follows:

12               SELECTIVE SERVICE REGISTRATION AWARENESS AND COMPLIANCE

13        46-501.  PURPOSE OF THE CHAPTER. The purpose of this chapter is to encour-
14    age  compliance with the federal military selective service act and to protect
15    the eligibility of the citizens of this state who are subject  to  the  provi-
16    sions of the federal statute to receive federal financial assistance for post-
17    secondary  education  and for employment with the executive branch of the fed-
18    eral government. The federal selective service registration awareness and com-
19    pliance act requires persons subject to the provisions of the federal military
20    selective service act to be in compliance with the requirements of  that  fed-
21    eral statute as a condition of eligibility for enrollment at a state-supported
22    institution  of  postsecondary education, or for state-supported scholarships,
23    programs of financial assistance funded by  state  revenue  including  federal
24    funds,  gifts  or grants accepted by the state, or for employment by the state
25    or any political subdivision.

26        46-502.  LEGISLATIVE FINDINGS. The legislature of the state of Idaho finds
27    that the military selective service act at 50 U.S.C. sec. 451 et seq. requires
28    all male citizens and every other male person residing in the  United  States,
29    except  for  lawfully  admitted nonimmigrant aliens, upon reaching their eigh-
30    teenth birthday to register with the United States selective  service  system.
31    The legislature further finds that federal statutes limit eligibility for fed-
32    eral  student  financial  assistance and eligibility for employment within the
33    executive branch of the federal government to persons who  are  in  compliance
34    with the requirements of the federal military selective service act.

35        46-503.  ELIGIBILITY  FOR POSTSECONDARY EDUCATION AND FINANCIAL ASSISTANCE
36    -- RESPONSIBILITY TO VERIFY COMPLIANCE. (1) A  person  may  not  enroll  in  a
37    state-supported institution of postsecondary education unless he is in compli-
38    ance with the federal military selective service act.
39        (2)  A  person  may not receive a loan, grant, scholarship or other finan-
40    cial assistance for postsecondary education funded by state revenue, including

 1    federal funds or gifts and grants accepted by this state, or receive a student
 2    loan guaranteed by the state unless he is in compliance with the federal mili-
 3    tary selective service act.
 4        (3)  It shall be the duty of all officials having charge of and  authority
 5    over  state-supported  institutions  of  postsecondary  education and over the
 6    granting of state-supported financial assistance for  postsecondary  education
 7    to  assure themselves that applicants are in compliance with the federal mili-
 8    tary selective service act. The institutions are  authorized  to  develop  the
 9    necessary form to allow the applicant to certify compliance with the selective
10    service act.

11        46-504.  ELIGIBILITY  FOR  EMPLOYMENT  -- RESPONSIBILITY TO VERIFY COMPLI-
12    ANCE. (1) No male person who has attained the age of eighteen (18)  years  who
13    fails to be in compliance with the federal selective service act shall be eli-
14    gible for employment by or service for the state of Idaho, or a political sub-
15    division  of  the  state,  including  all boards and commissions, departments,
16    agencies, institutions and instrumentalities.
17        (2)  It shall be the duty of all officials having charge of and  authority
18    over  hiring  of employees by the state or political subdivisions of the state
19    to assure themselves that applicants are in compliance with the federal  mili-
20    tary  selective  service act. The hiring authorities are authorized to develop
21    the necessary form to allow the  applicant  to  certify  compliance  with  the
22    selective service act.

23        46-505.  EXCEPTIONS  TO  THE  REQUIREMENTS OF THIS CHAPTER. A person shall
24    not be denied a right, privilege or benefit under this chapter  by  reason  of
25    failure  to present himself for and submit to the requirement to register pur-
26    suant to the federal military selective service act if:
27        (1)  The requirement for the person  to  so  register  has  terminated  or
28    become inapplicable to the person; or
29        (2)  The  person  is serving or has already served in the armed forces, or
30    has a condition that would preclude acceptability for military service.
