 1                                        AN ACT
 2    RELATING TO THE IDAHO ELECTRICAL BOARD; AMENDING SECTION 54-1006, IDAHO  CODE,
 3        TO INCREASE MEMBERSHIP OF THE BOARD AND TO SPECIFY QUALIFICATIONS FOR MEM-
 4        BERS OF THE BOARD.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION  1.  That  Section 54-1006, Idaho Code, be, and the same is hereby
 7    amended to read as follows:

 8        54-1006.  IDAHO ELECTRICAL BOARD. (1) The Idaho electrical board,  herein-
 9    after known as the board, is hereby created and made a part of the division of
10    building  safety. It shall be the responsibility and duty of the administrator
11    of the division of building safety to administer and enforce the provisions of
12    this act, to serve as secretary to the Idaho electrical board, and to  appoint
13    the chief electrical inspector.
14        (2)  The  board  shall  consist  of    seven   nine 
15    ( 7  9 ) members to be appointed by  the  governor  with
16    power of removal for cause.  Two (2) members shall be licensed journeymen
17    or  master  electricians;  two  (2)  members shall be employees or officers of
18    licensed electrical contractors; one (1) member shall be a licensed  specialty
19    journeyman or contractor; one (1) member shall be an employee or officer of an
20    electrical power provider; one (1) member shall be an employee or officer of a
21    manufacturing  plant  or  other  large  power user; one (1) member shall be an
22    employee or director of a manufacturer or distributor of  electrical  supplies
23    or  materials;  and  one  (1)  member  shall  be  from the public at large not
24    directly associated with the electrical industry.  Board  members  shall
25    be appointed for a term of four (4) years. Whenever a vacancy occurs, the gov-
26    ernor  shall  appoint a qualified person to fill the vacancy for the unexpired
27    portion of the term.
28        (3)  All members of the board shall be citizens of the United States, res-
29    idents of this state for not less than two (2) years and shall be qualified by
30    experience, knowledge and integrity in formulating rules for examinations,  in
31    passing  on  the  fitness and qualifications of applicants for electrical con-
32    tractor and journeyman electrician licenses and in establishing standards  for
33    electrical  products  to  be used in electrical installations coming under the
34    provisions of this act.
35        (4)  The members of the board shall, at their first regular  meeting  fol-
36    lowing  the  effective  date  of  this act and every two (2) years thereafter,
37    elect by majority vote of the members of the board, a chairman who shall  pre-
38    side at meetings of the board. In the event the chairman is not present at any
39    board meeting, the board may by majority vote of the members present appoint a
40    temporary  chairman. A majority of the members of the board shall constitute a
41    quorum.
42        (5)  The board is authorized and directed to  prescribe  and  amend  rules
43    consistent  with this act for the administration of this chapter and to effec-

 1    tuate the purpose thereof, and for the licensing of electrical contractors and
 2    the examination and licensing of journeyman electricians. The board shall also
 3    establish the fees to be charged for permits  and  inspections  of  electrical
 4    systems.
 5        (6)  Each  member  of the board not otherwise compensated by public moneys
 6    shall be compensated as provided by section 59-509(g), Idaho Code.

                        STATEMENT OF PURPOSE

This legislation expands the Idaho State Electrical Board from seven
(7) to nine (9) members. It provides for members to be selected from
specific segments of industry and the community to ensure an
impartial Electrical Board. Currently, without this requirement, the
Board may be perceived as being biased, impairing its effectiveness
to perform its duties.



                            FISCAL NOTE

 Approximately $2,000 in additional cost for the two additional
board members to attend quarterly board meetings.
