H0228|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 228 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO SIMULCASTS OF DOG AND HORSE RACING; AMENDING SECTION 54-2514A, 3 IDAHO CODE, TO CLARIFY AN EFFECTIVE DATE, TO CLARIFY THAT SIMULCASTS OF 4 DOG RACING AND PARI-MUTUEL WAGERING ON THE SIMULCASTS SHALL BE ILLEGAL 5 AFTER JULY 1, 1999 AND TO CLARIFY THAT SIMULCASTS OF HORSE RACING AND 6 PARI-MUTUEL WAGERING ON THE HORSE RACING SIMULCASTS SHALL BE LEGAL AT CER- 7 TAIN FACILITIES IF CERTAIN CONDITIONS ARE COMPLIED WITH. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 54-2514A, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 54-2514A. DOG RACING ILLEGAL AFTER THE EFFECTIVE DATE OF THIS ACT. On and 12 afterthe effective date of this actMarch 18, 1996 , 13 live dog races and pari-mutuel betting on such races or the training of dogs 14 to compete in live dog races shall be illegal to be conducted in the state of 15 Idaho. The provisions of this section shall not be deemed to alter or affect 16 simulcasts of dog racing and simulcast pari-mutuel wagering 17 of dog racing at a facility that was licensed and authorized prior to 18 January 1, 1996, to conduct live dog races and pari-mutuel wagering on them 19 prior tothe effective date of this actMarch 18, 1996 20 , and such simulcasts of dog racing and pari-mutuel wager- 21 ing on such simulcasts may be conducted at that facility as if the facility 22 were still licensed and under the same conditions and restrictions imposed by 23 law on a licensee until July 1, 1999. The provisions of this section 24 shall not be deemed to alter or affect simulcasting of horse racing or 25 pari-mutuel wagering on the horse racing simulcasts at a facility that was 26 licensed and authorized prior to January 1, 1996, to conduct live dog races 27 and pari-mutuel wagering on them prior to March 18, 1996, as long as such 28 horse racing simulcasts and pari-mutuel wagering on the horse races are con- 29 ducted under the same conditions and restrictions imposed by law on a licen- 30 see with the exception that no live races shall be required. 31 Any person participating or conducting a live dog race or pari-mutuel bet- 32 ting on such a live dog race or the training of dogs to compete in live dog 33 races in violation of this section shall be guilty of a felony.
STATEMENT OF. PURPOSE RS 08949 The purpose of this legislation is to clarify the law involving the simulcasting of dog racing in Idaho. It was never intended that horse race simulcasting be eliminated in Idaho. This bill makes it clear that the sunset provision applies only to the simulcasting of dog racing in Idaho. FISCAL NOTE There will probably be some positive fiscal impact on track owners and to whomever else the tracks give money.
