H0256|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 256 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO HEALTH CARE PRACTITIONERS; AMENDING CHAPTER 13, TITLE 54, IDAHO 3 CODE, BY THE ADDITION OF A NEW SECTION 54-1301, IDAHO CODE, TO PROVIDE 4 THAT HEALTH CARE PRACTITIONERS SHALL WEAR IDENTIFYING NAME BADGES, TO PRO- 5 VIDE EXCEPTIONS, TO DEFINE TERMS AND TO PROVIDE THE EFFECT OF A VIOLATION. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Chapter 13, Title 54, Idaho Code, be, and the same is 8 hereby amended by the addition thereto of a NEW SECTION , to be 9 known and designated as Section 54-1301, Idaho Code, and to read as follows: 10 54-1301. HEALTH CARE PRACTITIONERS. A health care practitioner shall 11 identify that he or she is licensed or certified by displaying either the 12 title or abbreviation of the appropriate licensure or certification on a name 13 tag or other similar form of identification during times when the person is 14 providing direct patient care. A health care practitioner in a practice or an 15 office, whose license, is prominently displayed, may choose to not wear a name 16 tag. 17 In the interest of public safety and consumer awareness, it shall be 18 unlawful for any person to use the title "nurse" in reference to himself or 19 herself in any capacity except for an individual who is a licensed profes- 20 sional nurse, an advanced practice nurse or licensed practical nurse. Nothing 21 in this section shall prohibit a certified nurses assistant from using his or 22 her title. For purposes of this section, "health care practitioner" means the 23 following persons who engage in acts that are subject to licensure or regula- 24 tion pursuant to title 54, Idaho Code: chapter 6 -- podiatrist; chapter 7 -- 25 chiropractor; chapter 9 -- dentist, dental hygienist; chapter 14 -- licensed 26 professional nurse, licensed practical nurse, advanced practice professional 27 nurse (certified nurse-midwife, clinical nurse specialist, nurse practitioner, 28 registered nurse anesthetist); chapter 15 -- optometrist; chapter 17 -- phar- 29 macist; chapter 18 -- physician assistant; chapter 22 -- physical therapist, 30 physical therapist assistant; chapter 23 -- psychologist; chapter 32 -- 31 social worker, certified social worker; chapter 34 -- licensed professional 32 counselor; chapter 35 -- dietitian; chapter 37 -- occupational therapist, 33 occupational therapist assistant; and chapter 43 -- respiratory care practi- 34 tioner, but shall not include a physician or surgeon. 35 Any person violating the provisions of this section may be subject to 36 appropriate discipline pursuant to their respective licensure laws.
STATEMENT OF PURPOSE RS08607C4 This purpose of this legislation is to amend Chapter 13, Title 54 by adding a new section, Section 54-1301, to require that health care practitioners wear identifying name badges. Name badges shall identify that the health care practitioner is licensed or certified and display the appropriate title or abbreviation of the appropriate licensure or certification. FISCAL NOTE There is no impact to the General Fund. An approximate cost of $3.00 per name tag could be incurred by the state or county agencies or an individual if they are not currently in compliance with this requirement. CONTACT: Rep.
