LICENSE PLATES - SPECIAL - Amends existing law to provide that, if in each
of two consecutive years, fewer than one thousand license plates are issued
per year for a special license plate program, the Idaho Transportation
Department shall advise the Legislature and appropriate action may be taken
to discontinue that special license plate program; and to provide
exceptions.

 1                                        AN ACT
 2    RELATING TO SPECIAL LICENSE PLATE PROGRAMS; AMENDING  SECTION  49-402C,  IDAHO
 3        CODE,  TO  PROVIDE THAT IF IN EACH OF TWO CONSECUTIVE YEARS FEWER THAN ONE
 4        THOUSAND LICENSE PLATES ARE ISSUED PER YEAR FOR A  SPECIAL  LICENSE  PLATE
 5        PROGRAM,  THE  DEPARTMENT  SHALL  ADVISE  THE  LEGISLATURE AND APPROPRIATE
 6        ACTION MAY BE TAKEN TO DISCONTINUE THAT SPECIAL LICENSE PLATE PROGRAM,  TO
 7        PROVIDE EXCEPTIONS AND TO PROVIDE A CORRECT CODE CITATION.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION  1.  That  Section 49-402C, Idaho Code, be, and the same is hereby
10    amended to read as follows:

11        49-402C.  SPECIAL LICENSE PLATE PROGRAMS -- STANDARDIZED PLATE  COLOR  AND
12    DESIGN.  (1)  It  is the intent of the legislature that special license plates
13    issued by the department be readily recognizable as plates from the  state  of
14    Idaho  without  losing the uniqueness for which the special plate was designed
15    and purchased. In addition, the legislature  finds  that  the  department  can
16    operate  in  a  more  efficient,  cost-effective  manner by conforming special
17    plates to a basic color and design.
18        (2)  No special license plates and no special license  plate  programs  in
19    existence  on  or before June 30, 1998, shall be affected by the provisions of
20    this section. On and after July 1, 1998, any new special license plate program
21    authorized or any redesign of an existing special license plate, shall use the
22    same red, white and blue background as the standard issue  of  license  plates
23    described  in  section  49-4 33  43 , Idaho Code, except
24    that:
25        (a)  The identification of county shall be omitted;
26        (b)  The word "Idaho" shall appear on every plate;
27        (c)  The inscription "Scenic Idaho" may  be  omitted  without  legislative
28        consideration and approval; and
29        (d)  No  slogan shall be used that infringes upon, dilutes or compromises,
30        or could  be  perceived  to  infringe  upon,  dilute  or  compromise,  the
31        trademarks  of  the  state of Idaho, including, but not limited to, "Idaho
32        Potatoes  ," "Grown in Idaho  ," "Famous Idaho  Potatoes    "  or  "Famous
33        Potatoes   ."
34    The  provisions  of  this  section  shall not apply to the second plate design
35    issued pursuant to the provisions of section 49-417, Idaho Code.
36        (3)  Any redesign required for a special plate to conform with legislative
37    intent and the provisions of this section may be done in a manner  similar  to
38    that used to produce the original design.
39        (4)  The  special plates shall conform in all other respects with the pro-
40    visions of section 49-443, Idaho Code, relating  to  visibility  requirements,
41    display of registration number, time period for validity of plates, and reser-
42    vation of plate numbers.
43          (5)  Following an introductory period of two (2) years during which

 1    the provisions of this subsection shall not apply, if, for two (2) consecutive
 2    years, fewer than one thousand (1,000) plates are issued per year for  a  spe-
 3    cial license plate program, the department shall so advise the legislature and
 4    assist the legislature in adopting appropriate action to discontinue that spe-
 5    cial license plate program. The provisions of this subsection shall apply only
 6    to special license plate programs created after July 1, 1998. 

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE
                              RS09208

The purpose of this legislation is to place in code a mechanism for
discontinuing certain specialty license plate programs that fail to
maintain a level of profitability.







                            FISCAL NOTE

There will be no fiscal impact on the general fund of the state.
