HCR007|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 7 BY JUDICIARY, RULES AND ADMINISTRATION COMMITTEE 1 A CONCURRENT RESOLUTION 2 PROVIDING FOR PRINTING THE SESSION LAWS, FIXING THE PRICE FOR PRINTING THE 3 SAME, AND THE PRICE WHICH THE PUBLIC SHALL BE CHARGED FOR COPIES OF THE 4 SESSION LAWS. 5 Be It Resolved by the Legislature of the State of Idaho: 6 WHEREAS, Section 67-904, Idaho Code, has made provisions for the printing 7 of the Session Laws; 8 NOW, THEREFORE, in accordance with a written contract duly made and 9 entered into by the Speaker of the House of Representatives and the President 10 Pro Tempore of the Senate and the House Judiciary, Rules, and Administration 11 Committee and the Senate Judiciary and Rules Committee of the Legislature of 12 the State of Idaho hereinafter referred to as the Joint Committee; 13 BE IT RESOLVED by the members of the First Regular Session of the 14 Fifty-fifth Idaho Legislature, the House of Representatives and the Senate 15 concurring therein, that the contract for the printing of the Session Laws of 16 the First and Second Regular Sessions, Fifty-fifth Idaho Legislature, and the 17 Session Laws of any Extraordinary Session, Fifty-fifth Idaho Legislature, in 18 accordance with the provisions of law and in accordance with the written con- 19 tract between the Speaker of the House of Representatives and the President 20 Pro Tempore of the Senate and the Joint Committee as party of the first part, 21 and THE CAXTON PRINTERS, LTD., of Caldwell, Idaho, as party of the second 22 part, be, and the same is hereby ratified, confirmed and concurred in, and is 23 incorporated herein and made a part of this resolution, in words and figures 24 following, to wit: 25 PRINTING CONTRACT 26 THIS AGREEMENT, made and entered into this 11th day of January, 1999, by 27 and between the Speaker of the House of Representatives, Bruce Newcomb, and 28 the President Pro Tempore of the Senate, Jerry T. Twiggs, the Joint Committee 29 of the House Judiciary, Rules, and Administration Committee and the Senate 30 Judiciary and Rules Committee of the Legislature of the State of Idaho, here- 31 inafter mentioned as party of the first part, and THE CAXTON PRINTERS, LTD., 32 of Caldwell, Idaho, hereinafter mentioned as party of the second part; 33 WITNESSETH: 34 That pursuant to a resolution of said party of the first part and written 35 bid submitted to the said party of the first part by the party of the second 36 part, contract for legislative printing is hereby awarded to said THE CAXTON 37 PRINTERS, LTD., as follows: 38 SESSION LAWS 39 For printing and binding one thousand two hundred (1,200) copies of the 40 Session Laws of the First Regular Session of the Fifty-fifth Idaho Legislature 41 and for printing and binding one thousand two hundred (1,200) copies of the 42 Session Laws of the Second Regular Session of the Fifty-fifth Idaho Legisla- 2 1 ture and the Session Laws of any Extraordinary Session of the Fifty-fifth 2 Idaho Legislature: Twenty-five dollars and seventy-five cents ($25.75) per 3 page, f.o.b. Boise, Idaho, if produced by offset lithography with camera-ready 4 copy being furnished party of the second part, plus five dollars and fifty 5 cents ($5.50) per volume for binding. For pages requiring reduction shots, an 6 additional seven dollars ($7.00) per page charge. Each volume to be Smythe 7 sewed, rounded and backed with suitable headbands and Roxite Library Buckram 8 over a 15 point Red Label Davey Board. The party of the second part shall pro- 9 vide an additional quantity to be made available to the general public at 10 thirty-five dollars ($35.00) per single volume, and forty-two dollars ($42.00) 11 per set of two volumes, if a second volume is required. The Session Laws of 12 any Extraordinary Session adjourned prior to June 1, 1999, shall be included 13 in the Session Laws of the First Regular Session, or if adjourned prior to 14 June 1, 2000, shall be included in the Session Laws of the Second Regular Ses- 15 sion. No charge shall be made by the party of the second part for proofreading 16 or blank pages. 17 IT IS AGREED between the parties hereto that all of said printing shall be 18 done in the form and manner as submitted in written bid dated October 5, 1998, 19 by party of the second part, and in compliance with the statutes of the State 20 of Idaho where not otherwise provided, such statutes shall be controlling. 21 IT IS FURTHER AGREED that said Session Laws shall be printed, delivered to 22 and be ready for distribution by the Secretary of State in conformity with the 23 provisions of Section 67-904, Idaho Code, which section is hereby referred to 24 and by such reference made a part of this contract as though set forth at 25 length herein, and particularly as follows: 26 The Session Laws shall be printed and made available for distribution 27 within sixty (60) days after the last day on which the Governor may sign or 28 approve bills following adjournment of the session of the legislature which 29 enacted or passed the measures included in the Session Laws, or within thirty 30 (30) days after the delivery to the party of the second part of the proper 31 title pages, certificate pages, tables of laws and statutes amended and 32 repealed and a proper index of the contents of the Session Laws, whichever 33 date is first in time. 34 Such printing and delivery of said Session Laws to the Secretary of State 35 are to be made as provided by law; that for each day's failure to so deliver 36 volumes of such Session Laws as herein provided, there shall be deducted from 37 the contract price for printing said Session Laws the sum of fifty dollars 38 ($50.00) per day for each day's delay; provided, however, that the party of 39 the second part shall not be held responsible for delay occasioned by failure 40 to furnish copy for such printing to the party of the second part and such 41 delay shall, to the same extent, extend the time for the performance of this 42 agreement. 43 IN WITNESS WHEREOF, the party of the second part has caused these presents 44 to be executed by its proper officials, and the party of the first part, by 45 Concurrent Resolution has caused these presents to be executed by its proper 46 officials. 3 1 Party of the First Part 2 By /s/ Bruce Newcomb 3 BRUCE NEWCOMB, SPEAKER OF THE HOUSE 4 HOUSE JUDICIARY, RULES, AND ADMINISTRATION COMMITTEE 5 By /s/ Celia R.
