                            HOUSE CONCURRENT RESOLUTION NO. 21

                               BY WAYS AND MEANS COMMITTEE

 1                               A CONCURRENT RESOLUTION
 2    STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO
 3        APPOINT A COMMITTEE TO UNDERTAKE  AND  COMPLETE  A  STUDY  OF  THE  PUBLIC
 4        EMPLOYEE RETIREMENT SYSTEM AND OPTIONS WHICH COULD PROVIDE ENHANCEMENTS OR
 5        ALTERNATIVES TO THE EXISTING PROVISIONS.

 6    Be It Resolved by the Legislature of the State of Idaho:

 7        WHEREAS, the Legislature is aware of the importance of the Public Employee
 8    Retirement  System (PERSI) and the benefits provided to employees of the state
 9    and many political subdivisions as a part of this system; and
10        WHEREAS, several matters  have  come  before  the  Legislature  addressing
11    enhancements to PERSI; and
12        WHEREAS,  it  is  essential to maintain and assure the fiscal integrity of
13    PERSI, but to also assure that the state and other participating entities con-
14    tinue to provide a competitive benefit program and maintain sufficient  alter-
15    natives to attract and keep a quality work force;
16        WHEREAS, a comprehensive review of existing PERSI benefits and alternative
17    benefits which might be provided is warranted.
18        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
19    of  the  Fifty-fifth  Idaho  Legislature, the House of Representatives and the
20    Senate concurring therein, that  the  Legislative  Council  is  authorized  to
21    appoint  a  committee to undertake and complete a study of the Public Employee
22    Retirement System and options which could provide enhancements or alternatives
23    to the existing provisions. It is intended  that  the  study  will  include  a
24    review  of  what, if any, unfunded mandates these measures might pass along to
25    local governments, as well as a review of the  study  conducted  by  PERSI  in
26    1997,  which  provides  a  comparison  of the PERSI plan (defined benefit) and
27    defined contribution options. The Legislative Council shall determine the num-
28    ber of legislators and membership from each house appointed to  the  committee
29    and shall authorize the committee to receive input, advice and assistance from
30    interested and affected parties who are not members of the Legislature.
31        BE IT FURTHER RESOLVED that nonlegislative members of the committee may be
32    appointed  by  the cochairs of the committee who are appointed by the Legisla-
33    tive Council. Nonlegislative members of the advisory committee  shall  not  be
34    reimbursed  from legislative funds for per diem, mileage or other expenses and
35    shall not have voting privileges regarding the committee's recommendations  or
36    proposed legislation.
37        BE  IT FURTHER RESOLVED that the committee shall report its findings, rec-
38    ommendations and proposed legislation, if any, to the Second  Regular  Session
39    of the Fifty-fifth Idaho Legislature.

                       STATEMENT OF PURPOSE

This resolution would authorize the Legislative Council to appoint
an interim committee to undertake and complete a study of the Public
Employee Retirement System and options which could provide
enhancements or alternatives to the existing provisions.






                                 
                           FISCAL NOTE

If this resolution is adopted by the Legislature and the committee
is appointed by the Legislative Council, any necessary legislator
travel and per diem expense would be paid from the existing
legislative appropriation to the Senate and the House of
Representatives. Funding for staff support and expenses would be
provided from the existing appropriation to the Legislative Council
for the Legislative Services Office. There would be no additional
impact on the state General Fund as a result of this resolution.
