S1003|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1003 BY SCHROEDER 1 AN ACT 2 RELATING TO KINDERGARTENS; AMENDING SECTION 33-208, IDAHO CODE, TO PROVIDE 3 THAT SCHOOL DISTRICTS SHALL OFFER KINDERGARTEN UNLESS THEY HAVE THE WRIT- 4 TEN CONSENT OF FIFTY PERCENT OR MORE OF THE PARENTS OR GUARDIANS OF KIN- 5 DERGARTEN AGE CHILDREN WITHIN THE SCHOOL DISTRICT TO NOT OFFER A KINDER- 6 GARTEN PROGRAM. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 33-208, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 33-208. KINDERGARTENS AND CHILD ATTENDANCE NOT COMPULSORY. It shall11notbe compulsory for individual school districts to establish a kin- 12 dergarten program as provided in this section ;and13 but it shall not be mandatory for a child who is eligible by age 14 for attendance to enroll in an established public kindergarten. A school 15 district shall offer a kindergarten program unless the school district has 16 the written consent of fifty percent (50%) or more of the parents or guardians 17 of kindergarten age children residing within the school district to not offer 18 a kindergarten program.
STATEMENT OF PURPOSE RS 08589C1 The purpose of this legislation is to provide that school districts shall offer kindergarten unless they have the written consent of fifty percent or more of the parents or guardians of kindergarten age children within the school district to not offer a kindergarten program. FISCAL IMPACT All school districts currently offer kindergarten programs so there will be no fiscal impact to the General Fund or to local school districts. S1003 S 100
