 1                                        AN ACT
 2    RELATING TO INSURANCE BENEFITS FOR PART-TIME  WORKERS;  AMENDING  CHAPTER  18,
 3        TITLE  41,  IDAHO  CODE,  BY  THE ADDITION OF A NEW SECTION 41-1847, IDAHO
 4        CODE, TO PROVIDE FOR INSURANCE BENEFITS FOR CERTAIN PART-TIME  WORKERS  OF
 5        CERTAIN  EMPLOYERS, TO PROVIDE APPLICATION TO CONTRACTS, AGREEMENTS, POLI-
 6        CIES AND CERTIFICATES EXECUTED, FOR DELIVERY, CONTINUED OR RENEWED IN THIS
 7        STATE ON AND AFTER JULY 1, 1999, AND TO PROVIDE WHEN RENEWAL OCCURS.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION 1.  That Chapter 19, Title 41, Idaho Code, be,  and  the  same  is
10    hereby  amended  by  the addition thereto of a  NEW SECTION , to be
11    known and designated as Section 41-1847, Idaho Code, and to read as follows:

12        41-1847.  INSURANCE BENEFITS FOR CERTAIN PART-TIME WORKERS. For  the  pur-
13    poses of chapters 21, 22, 28, 32, 34, 39, 40, 47 and 52 of this title and not-
14    withstanding  any other provision of law, cost-sharing requirement, benefit or
15    service limitation for outpatient or inpatient programs, any contract,  agree-
16    ment,  policy  or  certificate  providing  for  reimbursement or payment to an
17    insurance subscriber, policyholder, insured or certificate holder  or  to  any
18    other  person  for  medical goods or services, or for reimbursement or payment
19    provided under any contract, agreement, policy or certificate  which  is  pro-
20    vided  to  all  full-time  employees  of  an  employer with fifty (50) or more
21    employees shall be provided to employees who work  more than  three  (3)  four
22    (4) hour shifts per week for more than a three (3) month period.

23        SECTION 2.  APPLICATION. Except as otherwise provided, the requirements of
24    Section  41-1847, Idaho Code, apply to all contracts, agreements, policies and
25    certificates executed, delivered, issued for delivery, continued or renewed in
26    this state on and after July 1, 1999. For purposes of this act all  contracts,
27    agreements,  policies  and  certificates  are deemed renewed no later than the
28    next yearly anniversary of the  contract,  agreement,  policy  or  certificate
29    date.

      This measure will compel large businesses that employ more
      than 50 workers to provide health insurance benefits to
      employees who work more than 3-4 hour shifts weekly over a
      three month period.
