                                   SENATE BILL NO. 1019

                             BY HEALTH AND WELFARE COMMITTEE

 1                                        AN ACT
 2    RELATING TO THE IDAHO COUNSELOR LICENSING  BOARD;  AMENDING  SECTION  54-3405,
 3        IDAHO  CODE, TO STRIKE OBSOLETE LANGUAGE AND TO PROHIBIT LICENSURE OF CER-
 4        TAIN INDIVIDUALS SANCTIONED BY ANOTHER LICENSING ENTITY; AMENDING  SECTION
 5        54-3408,  IDAHO  CODE,  TO  STRIKE LANGUAGE GOVERNING LICENSURE OF CERTAIN
 6        INDIVIDUALS SANCTIONED BY ANOTHER LICENSING ENTITY; AND  AMENDING  SECTION
 7        54-3411, IDAHO CODE, TO ESTABLISH THE EXAMINATION FEE TO BE CHARGED.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION  1.  That  Section 54-3405, Idaho Code, be, and the same is hereby
10    amended to read as follows:

11        54-3405.  QUALIFICATIONS FOR LICENSURE. Licensure as a  "licensed  profes-
12    sional  counselor"  shall  be restricted to persons who have successfully com-
13    pleted each of the following requirements:
14        (1)  A planned graduate program of sixty (60) semester hours which is pri-
15    marily counseling in nature, six (6) semester hours of which are earned in  an
16    advanced counseling practicum, and including a graduate degree in a counseling
17    field  from an accredited university or college offering a graduate program in
18    counseling.
19        (2)  An examination if required by the board's    regulations  
20     rules .
21        (3)  One  thousand  (1,000)  hours  of supervised experience in counseling
22    acceptable to the board.
23         Within the period from the effective date of this chapter until July
24    1, 1983, an applicant shall be exempt from the provisions of this section:
25        (1)  Who holds at least a master's degree in counseling or a related field
26    from an accredited college or university.
27        (2)  Who, if required by the board, passes an  examination  in  counseling
28    skills and/or knowledge.
29        (3)  Who  has  supervised  counseling  experience acceptable to the board.
30    
31         (4)  A license or conditional license will not be allowed  an  indi-
32    vidual  whose  license, certification or registration has been revoked or sus-
33    pended in this or any other state and in this or any other related field. Such
34    an individual may not be licensed under this  chapter  unless  the  period  of
35    revocation or suspension has been completed and the board has conducted a com-
36    petency  review and determined that an acceptable degree of rehabilitation has
37    been accomplished. 

38        SECTION 2.  That Section 54-3408, Idaho Code, be, and the same  is  hereby
39    amended to read as follows:

40        54-3408.  CERTAIN  ACTS  PROHIBITED.  The following acts shall be unlawful
41    and punishable as a misdemeanor:

 1        (1)  The violation of any of the provisions of this chapter and any  rules
 2    promulgated pursuant thereto;
 3        (2)  A  person representing himself to be a licensed counselor or licensed
 4    professional counselor without having first complied with  the  provisions  of
 5    this chapter;
 6        (3)  A  person  who shall practice or attempt to offer to practice profes-
 7    sional counseling, as defined in this chapter, without having at the  time  of
 8    so doing, a valid, unexpired, unrevoked and unsuspended license or conditional
 9    license issued under this chapter or the laws of Idaho or any other state gov-
10    erning mental health professionals ;
11        (4)  A  license  or  conditional license will not be allowed an individual
12    whose license, certification, or registration has been revoked or suspended in
13    this or any other state and in this or any other related field. Such an  indi-
14    vidual  may not be licensed under this chapter unless the period of revocation
15    or suspension has been completed and the  board  has  conducted  a  competency
16    review  and  determined  that  an acceptable degree of rehabilitation has been
17    accomplished .

18        SECTION 3.  That Section 54-3411, Idaho Code, be, and the same  is  hereby
19    amended to read as follows:

20        54-3411.  FEES  ON LICENSURE. The board shall establish fees for licensure
21    under the provisions of this chapter as follows:
22        (1)  The fee for applications not to exceed one hundred dollars ($100).
23        (2)  The fee for examination, when required,   not  to  exceed  fifty
24    dollars  ($50.00)   equal to that charged by the national examining
25    entity .
26        (3)  The fee for reciprocity not to exceed one hundred dollars ($100).
27        (4)  The fee for the original license not to exceed  one  hundred  dollars
28    ($100).
29        (5)  The fee for annual renewal not to exceed sixty dollars ($60.00).
30        (6)  Fees  under  subsections (2) or (3) of this section shall be in addi-
31    tion to the application fee.
32        (7)  All fees paid pursuant to this section shall be nonrefundable.

                      STATEMENT OF PURPOSE

Amend existing statute by deleting obsolete language
pertaining to grandfather provisions; move Section 54-
3408(4), Idaho Code, to a more appropriate section in the
statute, Section 54-3406, Idaho Code, and to set examination
fee to that charged by the national examining entity.

                         FISCAL IMPACT

There is no fiscal impact to the General Fund or dedicated
funds .
