                                   SENATE BILL NO. 1069

                             BY HEALTH AND WELFARE COMMITTEE

 1                                        AN ACT
 2    RELATING TO THE IDAHO BOARD OF CHIROPRACTIC PHYSICIANS;  AMENDING  CHAPTER  7,
 3        TITLE 54, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 54-716, IDAHO CODE,
 4        TO REQUIRE THAT CHIROPRACTIC PHYSICIANS SHALL CARRY LIABILITY INSURANCE.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION  1.  That  Chapter  7,  Title  54, Idaho Code, be, and the same is
 7    hereby amended by the addition thereto of a  NEW SECTION  ,  to  be
 8    known and designated as Section 54-716, Idaho Code, and to read as follows:

 9        54-716.  PROFESSIONAL  LIABILITY  INSURANCE. Each licensee who is actively
10    licensed under this chapter shall, as a condition to licensing, carry  profes-
11    sional liability insurance with an insurance company authorized to do business
12    in Idaho to cover a licensee's errors or omissions for all licensed activities
13    under the provisions of this chapter.
14        (1)  The  board shall determine by rule the terms and conditions of cover-
15    age required under the provisions of this section including, but  not  limited
16    to, the minimum limits of coverage, the permissible deductible and the permis-
17    sible exemptions.
18        (2)  A certificate of coverage, showing compliance with the required terms
19    and  conditions  of  coverage,  shall  be  filed with the board by the license
20    renewal date by each licensee.
21        (3)  The insurance coverage required in this section shall  become  effec-
22    tive  as  a  condition  of granting a license or renewing an active license on
23    July 1, 2000, and thereafter.

Amend existing statute by the addition of a new section to
establish all chiropractors must carry malpractice insurance.








                           FISCAL INPACT

There is no fiscal impact to the General Fund or dedicated
funds.
